Indenture 1892

This Indenture made the twenty fifth day of June One thousand eight hundred and ninety two Between The Rushden and District Freehold Land Society Limited established at Rushden in the County of Northampton and registered under the Industrial and Provident Societies Act 1876 (hereinafter called the said Society) of the first part Harry Cartwright of Rushden aforesaid Shopkeeper (hereinafter called the Vendor) of the second part and William Penness of Rushden aforesaid Lift Manufacturer (hereinafter called the Purchaser) of the third part Whereas the said Society being seized in fee simple in possession of the hereditaments hereinafter expressed to be hereby granted free from incumbrances sometime since contracted with the Vendor for the absolute sale to him of the same hereditaments with the appurtenances subject to the covenant hereinafter contained but free from Land Tax at the price of Thirty nine pounds seventeen shillings and one penny but no conveyance thereof has yet been executed And Whereas the Vendor has now contracted with the Purchaser for the absolute sale to him of the said hereditaments hereinafter expressed to be hereby granted for the sum of Forty two pounds three shillings and nine pence and hath requested the said Society to convey such hereditaments to the Purchaser in manner hereinafter appearing Now this Indenture Witnesseth that in pursuance of the said contracts and in consideration of the sum of Thirty nine pounds seventeen shillings and one penny paid to the said Society by the Purchaser (at the request of the Vendor) of which sum the said Society hereby acknowledge the receipt And in consideration of the sum of Two pounds six shillings and eight pence paid to the Vendor by the Purchaser (the payment and receipt in manner aforesaid of which said sums of Thirty nine pounds seventeen shillings and one penny and Two pounds six shillings and eight pence making together the said purchase money of Forty two pounds three shillings and nine pence the Vendor doth hereby admit and acknowledge The said Society As Beneficial Owners at the request and by the direction of the Vendor hereby grant and convey and the Vendor hereby releases and confirms unto the Purchaser All that plot of land situate at Rushden in the County of Northampton having a frontage to a new road called Montague Street in Rushden aforesaid of about thirty feet and containing in area as now stumped out three hundred and seventy five square yards or thereabouts which said plot of land is more particularly delineated and described by the plan drawn on the back of these presents and is therein numbered Lot 47 and coloured pink and by the dimensions boundaries and other particulars written upon or near to the same plan the said plot of land being situate on and part of a large estate recently laid out for building by the said Society situate on the North East side of the public road leading from Rushden to Wellingborough and known as the New Roads estate To hold the same freed from Land Tax but subject to the covenant hereinafter contained Unto and To The Use of the Purchaser in fee simple And the said Society hereby acknowledge the right of the Purchaser to production of the Documents of Title mentioned in the Schedule … and to delivery of copies thereof and hereby undertake for the safe custody thereof And the Purchaser hereby Covenants with the said Society that he the Purchaser and all persons claiming under him will at all times hereafter release perform and fulfill all and every the covenants restrictions and agreements as to the mode of building on and the occupation of the said hereditaments and otherwise Contained or referred to in a certain Indenture dated the twenty third day of January One thousand eight hundred and eighty six and expressed to be made between the several persons whose names [and seals] are respectively subscribed and set in the second Schedule thereto of the one part and the said Society of the other part so far as such covenants conditions and agreements to the said hereditaments hereinafter expressed to be hereby granted and are on the part of the purchaser of the same hereditaments to be observed performed or fulfilled In Witness whereof the said Society have caused their Common seal to be hereunto affixed and the Vendor and Purchaser have hereunto set their hands and seals the day and year first above written
