Builder and Architect

Harry Knight, builder, Rushden, v Wallis Wilkerson, chemist, Rushden. Claim for £19 1s. for work done, goods supplied, and labour. The chief item was £18 15s. for 2½ per cent on£750 for preparing plans and specifications for a new building. The defendant counter-claimed £1 15s. 10d., and paid £7 3s. 2d. into Court.—Mr Frank Newman, who appeared for the plaintiff, admitted the counter claim.—Mr. W. J. Henry appeared for the defendant.—In September, 1890, a part of Mr. Wilkerson’s property at Rushden was burnt down, and he consulted the plaintiff about making a plan for re-building. It was arranged that if the plaintiff did the re-building he should give the plan in; if some other builder got the work the plaintiff and defendant would arrange the price for the plans. The plaintiff’s tender was not accepted, and he had accordingly charged the defendant for preparing the plans. The charge he had made was 2½ per cent on the amount of the contract—just half the usual charge made by architects.—After hearing the case of the plaintiff, his Honour, without calling on the defence gave judgment for the amount paid into Court, considering that that would amply repay the plaintiff.
