George Newman – will 1855

I George Newman of Higham Ferrers in the County of Northampton Gentleman do hereby revoke all Wills Codicils and Testamentary dispositions heretofore made by me and declare this to be my last Will and Testament. I appoint Elias Collett Bridgman of Higham Ferrers aforesaid Baker and Maltster and William Brown of Higham Ferrers aforesaid Tailor and Mayor to be the Executors of this my Will I give and bequeath to my Niece Mary the wife of Henry Harvey the sum of one hundred pounds To my Niece Ann the Wife of Essor Harries the sum of one hundred pounds To my Niece Martha the Wife of Adam Kirk the sum of one hundred pounds and to my Niece Eliza the Wife of Benjamin James the sum of one hundred pounds and to each of my Nephews William Webber and George Webber a like sum of one hundred pounds I give and bequeath to the said George Webber the further sum of one hundred and eighty pounds Upon trust for such one or more of the children of the said George Webber as being sons or a son shall attain the age of twenty one years or being daughters or a daughter shall attain that age or be married equally to be divided among them if more than one as tenants in common Provided always that it shall be lawful for the said George Webber to pay and advance to and for the benefit of any one or more of his said children the whole or any part of the share in the said legacy to which such child shall be presumptively entitled in such manner as the said George Webber shall think fit notwithstanding such child shall not have attained the age of twenty one years or have married I give and bequeath unto Jane Newman and David Newman the children of my late Uncle David Newman late of West Cowes in the Isle of Wight the sum of nineteen guineas each and to the said Jane Newman all my plate and any watches or chains which I may have other than those hereinafter particularly mentioned and bequeathed Also to each of the children of my late Uncle Thomas Newman late of Newport in the Isle of Wight the sum of nineteen guineas Also to each of the children of my late Uncle John Newman late of Bembridge in the Isle of Wight the sum of nineteen guineas also to each of the children of my late Uncle Joseph Newman late of Portsmouth in the County of Hants the sum of nineteen guineas Also to George Roulson of Moulton in the County of Northampton Plumber and Glazier the sum of thirty pounds Also to Alice the Wife of the said George Roulson the sum of thirty pounds for her separate use and so that the receipt of her the said Alice Roulson shall alone be a sufficient discharge for the same and the further sum of four pounds for purchasing mourning and my frame picture piece of needle work and I give and bequeath unto the said Alice Roulson in the event of her surviving her said husband the interest which shall become due from and after the death of her said husband upon a mortgage debt of two hundred and fifty pounds due to me from the said George Roulson upon the security of his estate at Moulton aforesaid to hold the said interest unto the said Alice Roulson for and during the term of her natural life and I direct that the said mortgage debt shall not be called in during the life of the survivor of them the said George Roulson and Alice his Wife but that the interest thereof during the life of the said George Roulson and the capital after the decease of such survivor shall form part of my residuary estate and I give and bequeath unto each of my aforesaid Executors the sum of nineteen guineas for their trouble provided and on condition that they respectively undertake the execution of the trusts of this my Will and I give to the said Elias Collet Bridgman my gold repeater watch and its appendages and to the said William Brown my silver watch now in his possession and my horse gig and harness my trunks except as hereinafter mentioned and my linen and books and all my household goods and effects except such as are herein otherwise disposed of and bequeathed And I give and bequeath unto Sarah the Wife of the said William Brown the sum of fifty pounds for her separate use for which her receipt alone shall be a sufficient discharge and the further sum of four pounds to purchase mourning And I give and bequeath to Mary Ann daughter of the said William Brown the sum of fifty pounds and I give and bequeath unto Charles Brown son of the said William Brown the sum of twenty five pounds and my Bureau my gold shirt studs and my new leather travelling trunk and I give and bequeath to the Reverend George Malim Vicar of Higham Ferrers the sum of ten guineas as a mark of my respect towards him And I give to Henry Buswell of Moulton aforesaid Plumber and Glazier the sum of nineteen guineas as a mark of my respect and to Eliza the Wife of Frederick Buswell of Moulton aforesaid the sum of nineteen guineas as a mark of my respect to her for her separate use for which her receipt alone shall be a sufficient discharge and I give a mourning dress to the Servant Girl who may be in my service in the house at the time of my decease and to each of the bearers at my Funeral of whom I wish there to be six the sum of one pound and I give and devise all and every the messuages lands tenements and hereditaments whatsoever situate and of what nature or tenure soever of or to which I am now or at the time of my death shall be seized or entitled either at Law or in Equity for any devisable estate or interest or of which I how have power to dispose by this my Will unto and to the use of the said Elias Collet Bridgman and William Brown their heirs executors administrators and assigns according to the nature or tenure thereof Upon trust that they the said Elias Collett Bridgman and William Brown or the survivor of them or the heirs executors or administrators of such survivor or other trustees for the time being of this my Will do and shall as soon as conveniently may be after my decease absolutely sell and dispose of my said messuages lands tenements and hereditaments either entirely or altogether or in parcels and either by public auction or private contract for such price or prices as the said trustees or trustee may think reasonable with power to buy in the said premises or any part thereof at any sale or sales by auction and to recind or vary any contract for sale and to resell the premises which shall by so bought in or the contract for a sale whereof shall be so recinded or abandoned as aforesaid without being answereable for any loss to be occasioned thereby and also with power to insert any special or other stipulations as to title evidence of title conveyance or otherwise in any contract or condition of sale and to make do execute and enter into all such acts deeds contracts matters and things as they or he shall think fit and do and shall stand possessed of the monies to arise from such sale or sales upon the trusts hereinafter declared And I give and bequeath All the Personal Estate of or to which I may be at the time of my death possessed or entitled at Law or in Equity for any estate or interest which can be bequeathed by Will or of which I have the power to dispose by Will except such parts thereof as are hereinbefore specifically bequeathed and except chattel real included in the general devise hereinbefore contained of real estate and except also such personal estate as may be lawfully bequeathed In trust for charitable purposes unto the said Elias Collett Bridgman and William Brown Upon trust that the said Elias Collett Bridgman and William Brown or the survivor of them his executors or administrators or other the trustees or trustee for the time being of this my Will do and shall call in sell and dispose of my said personal estate and convert the same into money and to stand possessed of the monies to arise therefrom upon the trusts hereinafter declared And I hereby declare that the said Elias Collett Bridgman and William Brown and the survivor of them his executors or administrators or other the trustees or trustee for the time being of this my Will shall stand possessed of the monies to arise from my said real and personal estates in manner aforesaid Upon trust in the first place and in exoneration of such part of my personal estate as may lawfully be bequeathed for charitable purposes to pay satisfy and discharge my funeral and testamentary expences and all my debts and the legacies herein before bequeathed and which I may bequeath by any Codicil hereto And I give and bequeath all such parts of my personal estate as I can lawfully and validly bequeath for charitable purposes freed and discharged from the payment of my debts funeral and testamentary expences and legacies or from so much thereof as the proceeds of my real and personal estates already devised and bequeathed upon the trusts aforesaid shall be sufficient to pay and satisfy unto the said Elias Collett Bridgman and William Brown their executors administrators and assigns Upon trust to call in and convert into money such parts thereof as shall not consist of money and to invest the proceeds therof together with such parts of my personal estate as shall consist of money in the purchase of a competent share of any of the Parliamentary stocks or public funds of Great Britain or at interest on Government securities and to alter vary and transpose the said stocks funds and securities for others of the like nature at their or his discretion and do and shall receive the dividends interest and annual proceeds to arrive due in respect thereof and invest the same upon the like securities in the names or name of such trustees or trustee by way of accumulation until the end of the term of twenty one years next after my decease or until the said trust fund with the accumulations thereof shall be sufficient for the purposes hereinafter declared which shall first happen and then to transfer such fund with the said accumulations into the joint names of the persons or person who shall then be the trustees or trustee of this my Will and the then Vicar of the said Parish of Higham Ferrers if he shall be willing to act in the trusts hereinafter declared and the Mayor and three Senior Aldermen in the Corporation of Higham Ferrers so that there shall not be less than five trustees of the said Charity legacy And I direct that the trustees for the time being of the said Charity legacy shall stand possessed of the said Fund with the accumulations upon the trusts hereinafter mentioned that is to say Upon trust by with and out of the dividends interest and annual proceeds of the said trust fund to hire and provide from time to time suitable Cottages or Almshouses or a suitable Cottage or Almshouse for the residence of six old women either Widows or Spinsters Inhabitants of the Parish of Higham Ferrers and to select from time to time proper persons being such Widows or Spinsters as aforesaid to the number of six to occupy and permit them to occupy such Cottages or Almshouses Cottage or Almshouse and upon further trust by with and out of the dividends interest and annual proceeds to pay to each of such persons the sum of eight shillings per week for ever Provided always and I hereby direct that the trustees for the time being of the said Charity legacy shall have power in their discretion to suspend or remove any of the said persons from the enjoyment of the benefit thereof by reason of misconduct or such other reason as shall appear to them to be good and sufficient and to supply from time to time the places of the persons so removed Provided always that if the said trust fund shall not before the end of the said term of twenty one years amount to sufficient for the purposes aforesaid then and in such case similar provision shall be made for such smaller number of persons as the said trust funds shall be sufficient to provide for in manner aforesaid I give devise and bequeath all estates vested in me upon any trusts or by way of mortgage unto the said Elias Collett Bridgman and William Brown their heirs executors administrators and assigns according to the nature and tenure thereof respectively upon the trusts and subject to the equity of redemption at the time of my decease subsisting therein respectively and I hereby declare that the receipts of the said Elias Collett Bridgman and William Brown and the survivor of them or the heirs executors or administrators of such survivor or other the trustees or trustee for the time being of this my Will for any sum or sums of money for the purchase of the aforesaid hereditaments hereinbefore directed to be sold or any part thereof or for any other sums of money payable under or by virtue of this my Will in execution of the trusts thereof shall be good and effectual discharges for the same and exonerate all persons paying the same from the necessity of seeing to the application thereof or the propriety of any such sale provided also that in case the Trustees hereby appointed or any future trustees or trustee to be appointed as hereinafter is mentioned either of my said Will or the said charitable legacy shall die or be abroad for twelve calendar months at one time or be desirous of being discharged from or a decline or become incapable to act in the trusts hereof it shall be lawful for the surviving or continuing trustee or for the executors or administrators of the last surviving or continuing trustee by reciting under his hand to appoint one or more person or persons to be a trustee or trustees in the place of the trustee or trustees so dying being abroad desiring to be discharged or refusing declining or becoming incapable to act as aforesaid but so that the Vicar of the said Parish of Higham Ferrers shall always if willing to act as one of the Trustees of the said Charity legacy be appointed one of such Trustees and every such Trustee to be appointed under this power shall have all such and the same powers as if nominated as Trustee by this my Will Provided always that the several Trustees hereby appointed and to be appointed as aforesaid and their respective heirs executors and administrators shall be charged for such monies only as they shall actually receive by virtue of the trusts hereby declared and may retain and reimburse to themselves and himself all costs charges damages and expences which they shall incur sustain or be put unto in the execution of the aforesaid trusts in Witness whereof I have to this my Will contained on this and six preceding sheets of paper set my hand this nineteenth day of September in the year of our Lord one thousand eight hundred and fifty five
