94 Wellingborough Road

Abstract of Title of Henry Page to a freehold dwellinghouse known as
94 Wellingborough Road, Rushden in the County of Northampton – 1946

This Conveyance is made the tenth day of May One thousand nine hundred and forty-six between HENRY PAGE of Number 69 Robinson Road Rushden in the County of Northampton Retired Boot Foreman (hereinafter called "the Vendor") of the one part and RONALD JOSEPH PAGE of Number 69 Robinson Road aforesaid Decorator (hereinafter called ''the Purchaser'') of the other part

Whereas:-

1.    By a Conveyance dated the first day of November One thousand nine hundred and thirty-seven and made between Henry Packwood Adams Hedley John Adams and Cyril Edgar Adams of the first part Henry Adams of the second part and the Vendor of the third part the property hereinafter described was conveyed with other property unto the Vendor in fee simple

2.   The Vendor has agreed with the Purchaser for the sale to him of the said property hereinafter described for an estate in fee simple in possession free from incumbrances at the  price of Six hundred Pounds

Now This Deed Witnesseth as  follows:-

1.    In pursuance of the said Agreement and in consideration of the sum of Six hundred rounds paid by the Purchaser to the Vendor (the receipt of which sum the Vendor hereby acknowledges) the Vendor as Beneficial Owner hereby conveys unto the Purchaser the freehold messuage or dwellinghouse with the outbuildings barn yard and appurtenances to the same dwellinghouse with the outbuildings barn yard and appurtenances to the same belonging situate in and being Number 94 Wellingborough Road Rushden aforesaid as the same is now in the occupation of the Purchaser TO HOLD the same unto the Purchaser in fee simple SUBJECT TO and TOGETHER WITH the benefit of the existing rights of way and drainage and other rights and easements as heretofore used and enjoyed in common with the owners and occupiers for the time being of the adjoining messuages Numbers 96 96a 96b 98 and 100 Wellingborough Road Rushden aforesaid and Number 21 Moor Road Rushden aforesaid AND SUBJECT ALSO to the rights reserved to the Lord of the Manor of Rushden as contained in a certain Deed of Enfranchisement dated the fourteenth day of February One thousand nine hundred and twenty-five and made between The King's Most Excellent Majesty of the one part and John Packwood the Younger and Ruth Adams of the other part

2.     The Vendor hereby acknowledges the right of the Purchaser to production and delivery of copies of the before recited Conveyance of the first day of November One thousand nine hundred and thirty-seven and hereby undertakes for the safe custody thereof-------- ---- ---- ---- -----.

BY MORTGAGE made between John Packwood of No. 493 Green Lane Tottenham in the County of Middlesex Boot Dealer and Ruth Adams the Wife of Henry Adams of No. 2 Ardilaun Road Highbury in the County of London Butcher (thereinafter when referred to jointly called "The Mortgagors" of the first part Elizabeth Packwood of Rushden in the County of Northampton spinster of the second part and Thomas Brown of Wellingborough in the said County Boot Manufacturer and Walter Talbot Brown aforesaid Architect (thereinafter called “The Mortgagees”) of the third part.

RECITING seisin of John Packwood of Rushden aforesaid Builder (thereinafter called “The Testator”) the Father of the said John Packwood party thereto at the date of the Indenture next thereinafter recited

AND RECITING that the Testator by an Indenture dated the 3rd April 1903 and made between The Testator of the one part and Emmeline Paxton Watkin of the  other part conveyed the said freehold hereditaments thereby assured Unto and To the Use of the said Emmeline Paxton Watkin in Fee Simple and by a Conditional Surrender dated the 8th April 1903 surrendered the said Copyhold hereditaments thereby convenanted to be surrendered to the use of the said Emmaline Paxton Watkin in customary fee simple by way of Mortgage for securing the payment  of the  principal sum of £700 and interest thereon as therein mentioned

AND RECITING that by his will dated  the 8th March 1899 The Testator appointed his Son the said John Packwood and his Son-in-law the said Henry Adams Executors thereof and (inter alia) devised the said copyhold hereditaments thereby convenanted to be surrendered unto The Mortgagors and their heirs as to one of the said messuages then in the occupation of Walter Bobins Upon Trust that They The Mortgagors should at their discretion during the life of his Daughter the said Elizabeth Paokwood either permit her to occupy  the same messuage and premises or let the same and pay the gross rent thereof without any deduction to the said Elizabeth Packwood with remainder after the death of the said Elizabeth Packwood to the use of The Mortgagors their heirs and assigns as tenants in common in equal shares And as to the remaining five of the said six messuages with the appurtenances thereto To the use That the said Elizabeth Packwood might receive thereout (in exoneration of The Testators personal estate and all other his real estate) the weekly sum of 8s. 0d. during her life free from all deductions the first of such weekly sums to be paid to her on the first Saturday after his death And subject to the payment of the said weekly sum thereby charged thereon and  to the powers and remedies for recovering the same And subject also to the payment of all rates and other outgoings  payable during the life of the said Elizabeth Packwood in respect of the said Cottage and premises then in the occupation of the said Walter Robins all which rates and outgoings The Testator thereby charged on the said remaining five Cottages and premises to the use of The Mortgagors their heirs and assigns as tenants in common in equal shares and The Testator devised all his real estate whatsoever and wheresoever except what he otherwise disposed of thereby or by any Codicil thereto unto and to the use of The Mortgagors their heirs and assigns as  tenants in common equal shares

AND RECITING that The Testator died  on the 23rd July 1905 and his said Will was on the 14th August 1905 proved in the Principal Probate Registry by the said John Packwood and Henry Adams

AND RECITING that at a Court held in and for the Manor of Rushden on the 26th September 1907 The Mortgagors were admitted tenants to the said copyhold herditaments thereby covenanted to be surrendered upon the trusts and according to the purport and effect of the said Will of The Testator

AND RECITING that the said John Packwood and Henry Adams had by writing under their hands dated the 6th June 1911 assented to the devise to The Mortgagors of the residue of the deceased's real estate

AND RECITING that the said Emmiline Paxton Watkin then recently required The Mortgagors to pay off the said Mortgage debt of £700 and The Mortgagees had at the request of the Mortgagors and the said Elisabeth Packwood on or immediately before etc. paid the said sum of £700 to the said Emmeline Paxton Watkin upon the condition that the repayment to them of the said sum of £700 with interest thereon should be secured to them in the manner thereinafter appearing

AND RECITING that by an Indenture dated the 15th June 1911 and made between the said Emmiline Paxton Watkin of the one part and The Mortgagors of the other part the said freehold hereditaments thereby assured were released and conveyed Unto and To the Use of The Mortgagors in Fee Simple Discharged from all moneys secured by the said Indenture of the 3rd April 1903

AND RECITING that by Warrant under her hand dated the 15th June 1911 the said Emmeline Paxton Watkin acknowledged that she had received all principle interest and other moneys secured by the said Conditional Surrender of the 8th April 1903 and requested the Steward of the said Manor of Rushden to enter satisfaction of the said Conditional Surrender on the Court Rolls of the said Manor

IT WAS WITNESSED that in consideration  of £700 paid by The Mortgagees out of moneys belonging to them on a joint account to the said Emmiline Paxton Watkin at the request of The Mortgagors and the said Elizabeth Packwood as thereinbefore recited (the payment etc.) The Mortgagors thereby jointly and severally covenanted with The Mortgagees to pay to them on the 16th December then next the sum of £700 with interest thereon at the rate of £5. 0. 0 per centum per annum computed from the date of that Indenture and also to pay interest half yearly in default PROVISO for reduction of interest to £4. 0. 0. per centum per annum on prompt payment

PROVISO that the provision for reduction of interest should cease to operate in the event of a Receiver appointed or The Mortgagees entering into possession or receipt of the rents and profits

IT WAS ALSO WITNESSED (inter alia) that for the consideration aforesaid The Mortgagors thereby (with the privity and consent of the said Elizabeth Packwood) as Beneficial Owners covenanted with The Mortgagees that they The Mortgagors and all other necessary parties (if any) would forthwith at the cost of The Mortgagors surrender into the hands of the Lord of the Manor of Rushden according to the custom thereof

All THOSE six copyhold messuages or dwellinghouses with the outbuildings and appurtenances thereto situate in and near to Wellingborough Road Rushden aforesaid then formerly in the respective occupations of A Hornsey The Testator Mrs. Wilby --- Loddington B--- Perkins and --- Burgess and then of George Berry Mrs. Taylor William Brown C--- N---  Barkes the said Elizabeth Packwood and --- Burgess Together with all fences (the fence dividing the said hereditaments thereby covenanted to be surrendered from the adjoining hereditaments on the North or North West to be kept in repair by The Mortgagors and the fence dividing the said hereditaments thereby covenanted to be surrendered from the adjoining hereditaments on the South or South East to be kept in repair by the Owner of such adjoining hereditaments) ways easements and appurtenances whatsoever to the said hereditaments thereby covenanted to be surrendered or any part thereof appertaining or therewith then or theretofore enjoyed or reputed so to be And also all the estate and interest of The Mortgagors therein

TO THE USE of The Mortgagees their heirs and assigns for ever according to the custom of the said Manor by and under the rents fines suits and services anciently due and of right accustomed and subject to a condition for making void such surrender if the said sum of £700 with interest there on should be paid on the 16th December then next according to the foregoing covenant and proviso in that behalf And The Mortgagors and the said Elizabeth Packwood thereby respectively as Beneficial Owners according to their several or respective shares estates and interests in the premises charged all said Copyhold hereditaments with the payment of all principal money and interest intended to be thereby secured in accordance with the covenant and proviso in that behalf thereinbefore contained

COVENANT by The Mortgagors with The Mortgagees to keep the buildings insured against loss or damage by fire

EXECUTED by The Mortgagors and the said Elizabeth Packwood and attested

MEMORANDUM not affecting the property the subject of this Abstract.

June 1911. BY CONDITIONAL SURRENDER the said John Packwood and Ruth Adams (thereinafter called "The Mortgagors") in pursuance of the covenant contained in the before abstracted Indenture of the 16th June 1911 made between The Mortgagers of the first part Elizabeth Packwood of the second part and Thomas Brown and Walter Talbot Brown (thereinafter called "The Mortgagees") of the third part and in consideration of £700 paid by The Mortgagees out of moneys belonging to them on a joint account as therein mentioned did out of Court Surrender into the hands of Our Most Gracious Sovereign Lord King George the Fifth Lord of the said Manor by the hands and acceptance of Hubert William Miller Deputy Steward thereof according to the custom thereof

ALL the before abstracted hereditaments To which said hereditaments The Mortgagors were admitted Tenants at a Court held in and for the said Manor on the 26th September 1907 as devisees under the Will of John Packwood deceased.

TO THE USE of The Mortgagees their heirs and assigns for ever according to the custom of the said Manor by and under the rents fines suits and services anciently due and of right accustomed And subject to that express provision that if the sum of £700 with interest thereon should be paid on the l6th December then next according to the covenant and proviso in that behalf contained in the said Indenture then and in such case that surrender should be void and of no effect but otherwise should  be and remain in full force and virtue and subject to the powers provisos covenants declarations and agreements expressed and contained in or implied by the said Indenture

BY RECONVEYANCE made between Walter Talbot Brown of Wellingborough in the County of Northampton Architect (thereinafter called "The Mortgagee") of the one part and John Packwood of No. 493 Green Lanes Tottenham in the County of Middlesex Boot Dealer and Ruth Adams the Wife of Henry Adams of No. 2 Ardilaun Road Highbury in the County of London Butcher (thereinafter called "The Mortgagors") of the other part

SUPPLEMENTAL to an Indenture of Mortgage dated the 16th June  1911 and made between The Mortgagor of the first part Elizabeth Packwood of the second part and Thomas Brown and The Mortgagee of the third part (which said Indenture was thereinafter called "The Principal Indenture")

RECITING that the said Thomas Brown died on the 23rd November 1915

IT WAS WITNESSED that in consideration of all principal money and interest due under The Principle Indenture having been paid by The Mortgagors to the Mortgagee (the receipt etc.) The Mortgages thereby as Mortgagee granted released and conveyed unto the Mortgagors and their heirs

ALL the freehold hereditaments comprised in and assured by The Principal Indenture TO HOLD the same (subject as in The Principal Indenture was mentioned) Unto and TO THE USE of The Mortgagors in fee simple Discharged from all money secured by and all claims under The Principal Indenture EXECUTED by The Mortgagees and attested.

27th Novr. 1915. BY WARRANT the said Walter Talbot Brown acknowledged that he had that day received of from the said John Packwood and Ruth Adams all principal moneys and interest owing to on the security of the before abstracted Conditional Surrender made to him and the said Thomas Brown (who died on the 23rd November 1915) and directed the Steward of the said Manor to enter up satisfaction of the said Conditional Surrender on the Court Rolls of said Manor and for so doing that should be his sufficient warrant and authority.

BY ENFRANCHISEMENT made between The King's Most Excellent Majesty of the one part and the said John Packwood therein described as of No. 3 Ardilaun Road Highbury Park in the County of London Gentleman and the said Ruth Adams of No. 2 Ardilaun Road aforesaid Married Woman copyhold or customary tenants of the Manor of Rushden of the other part

IT WAS WITNESSED that in consideration of £50 paid into the hands of the Receiver General the Revenues of the Duchy of Lancaster by the said John Packwood and Ruth Adams (as appears by the receipt of the Deputy to the said Receiver General indorsed on abstracting presents His said Majesty by and with the advice and consent of His Chancellors and Council of said Duchy and upon the acceptance of the said John Packwood and Ruth Adams (testified their execution of abstracting presents) thereby released and confirmed unto the said John Packwood and Ruth Adams and their heirs for ever.

ALL THOSE four messuages cottages or tenements with the outbuildings thereto situate in and known as Nos. 94, 96, 98, and 100 Wellingborough Road Rushden aforesaid AND ALSO ALL THOSE six messuages cottages or tenements with the outbuildings thereto situate at the rear of and adjoining the last mentioned hereditament and which said hereditaments the said John Packwood and Ruth Adams were admitted tenants by the description following "All that peice of land situate at Rushden aforesaid adjoining the road leading from Rushden to Wellingborough having a frontage thereto of 87 feet 10 inches and containing as formerly stumped out 12 square yards (more or less) which said piece of ground formerly formed part of a close of land, sailed "Cottage Close" adjoining the road leading from Rushden to Wellingborough containing 1 acre 4 perches (more or less formerly in the occupation of William Achurch subsequently of Morris Whiting and then of Edwin Chettle and which said piece of ground was bounded an the North and North West by a piece of ground (being other part of the said close) sold by Adam Corrie Keep John Woolston and Charles Joseph Keep Woolston to Joseph Bayes and  on the South or South East by a piece of ground being the South or Southeastern end of the said Close sold by the said Adam Corrie Keep John Woolston and Charlas Joseph Keep Woolston to Charles Bayes (the fence dividing the said piece of ground from other part of the said Close sold as aforesaid to the said Joseph Bayes to be erected and kept in repair by John Packwood the Elder his heirs and assigns and the Fence dividing the said piece of ground from other part of the said Close so as aforesaid sold by the said Adam Corrie Keep John Woolston and Charles Joseph Keep Woolston to the said Charles Bayes to be erected and kept in repair by the said Charles Bayes his heirs and assigns) Together with all those six messuages cottages or tenements with the outbuildings thereto erected on the said piece of land or same part thereof by the said John Packwood deceased All which said premises were more particularly delineated and described on the plan annexed thereto and there an edged pink which said premises (thereinafter called "The enfranchised lands") were within and parcel of the said Manor of Rushden AND ALSO ALL ways paths passages waters water courses privileges advantages hereditaments and appurtenances whatsoever to the enfranchised lands belonging or in anywise appertaining All and singular which enfranchised lands were held by the said John Packwood and Ruth Adams by copy of Court Roll of the said Manor by virtue of an admission to them therof made at a Court holden for the said Manor on or about the 26th September 1907 Subject to Fealty Suit of Court and other the Services thereof due and by the custom of the said Manor to be done or performed in respect thereof EXCEPT nevertheless and always reserved out of that present Grant and Release unto His said Majesty His Heirs Successors and Assigns all Royal Mines and Mines of Coal and Ironstone and all other Mines and Minerals and Mineral Substances and all Oil and natural Gas lying in or under the enfranchised lands together with the right and free liberty for His and their officers grantees and tenants to enter upon all or any part of the enfranchised lands and to open work get and carry away all or any of the said Mines Minerals and Mineral substances and all Oil and natural Gas in or under any adjoining or other lands and also to lead and carry away across through or under the enfranchised lands all or any Minerals and Mineral Substances and all Oil and natural gas and other things of a like nature gotten out of any adjoining or other lands and for the purposes aforesaid to sink make erect and use all such pits buildings engines machinery roads works and conveniences upon through or under all or any of the enfranchised lands as should be necessary or expedient and in exorcising the liberties thereby excepted and reserved to withdraw support (whether vertical or lateral) from the surface of the enfranchised lands and any houses or other buildings which then were or thereafter might be erected there an but so that in exercising the liberties thereby excepted and reserved reasonable compensation or satisfaction when demanded should be made to the said John Packwood and Ruth Adams their heirs or assigns for any injury thereby caused.

TO HAVE and TO HOLD the enfranchised lands with their appurtenances (except and subject as thereinbefore excepted and reserved) UNTO and TO THE USE of the said John Packwood and Ruth Adams and their heirs for ever to be holden of the said Manor of Rushden in fee and common socage freed and discharged of and from all and all manner of fines heriots reliefs quit rents and other customary dues and payments suits and services whatsoever to which the same or any part thereof was or were then subject

PROVISO that nothing thereinbefore contained should prevent the said John Packwood and Ruth Adams their heirs and assigns from digging and getting Sand Gravel or Limestone out of the enfranchised lands

IT WAS ALSO WITNESSED that in consideration of the premises the said John Packwood and Ruth Adams thereby granted unto His Majesty His Heirs Successors and Assigns All the Mines Minerals and Mineral Substances except as aforesaid and all Oil and natural Gas lying in and under the enfranchised lands together with all such liberties in relation thereto as were thereinbefore excepted and reserved CERTIFICATE that the consideration did not exceed £500

SEALED with the Seal of the Duchy of Lancaster and executed by the said John Packwood and Ruth Adams and attested

RECEIPT for consideration money endorsed.

MEMORANDUM: That by a Conveyance dated the thirtieth day of May 1925 the dwellinghouse and premises known as Number 98 Wellingborough Road Rushden together with and subject to the then existing rights of way water supply and drainage ware conveyed to Owen Meadows.
MEMORANDUM: That by a Conveyance dated the thirty first day of August 1929 the dwellinghouse and premises known as Number 100 Wellingborough Road Rushden together with and subject to the then existing rights of way water supply and drainage were conveyed to Horace Cox.
MEMORANDUM: That by a Conveyance dated the twenty second day of December 1925 the dwellinghouse and premises known as Number 96 Wellingborough Road Rushden together with the then existing rights of way water supply and drainage were conveyed to Frederick Tom Short and his right to production of the within written deed was acknowledged.

Decr. 1929   BY WILL the said John Packwood appointed Georgia Davis Smith and Hedley John Adams to be the Executors thereof

March. 1930   The said John Packwood died.

April. 1930   Tha said Will (with a Codicil thereto) of tha said John Packwood was duly proved in tha Principal Probata Registry by the Executors therein named.

RECITING the Will of the said John Packwood (thereinafter called "the Testator") as before abstracted

AND RECITING that at the date of his death the Testator was possessed jointly with his Sister the said Ruth Adams in equal shares to the freehold dwellinghouse known as No. 94 Wellingborough Road Rushden aforesaid together with the two cottages and appurtenances in the rear thereof

AND RECITING that by his said Will the Testator devised all his interest at the time of his decease in the above mentioned premises unto his three Nephews Henry Packwood Adams Hedley John Adams and Cyril Edgar Adams in equal shares

AND RECITING the death and Probate of the said Will of the said John Packwood as before abstracted

The said George Davis Smith and Hedley John Adams thereby assented to the Testator's one half share or interest in the said premises being vested in the said Henry Packwood Adams Hedley John Adams and Cyril Edgar Adams in equal shares

1931    BY WILL the said Ruth Adams appointed Henry Adams of 2 Ardilaun Road Highbury aforesaid to be the sole Executors thereof and bequeathed unto the said Henry Packwood Adams Hedley John Adams and Cyril Edgar Adams her interest in the premises known as No. 94 Wellingborough Road Rushden aforesaid together with the two cottages and appurtenances in the rear thereof

9th March. 1932 BY DEED OF APPOINTMENT made between the said Henry Adams (thereinafter called "the Appointer" of the  one part and the said Henry Packwood Adams of "Woodbrook" Selly Oak Birmingham in the County of Warwick the said Hedley John Adams of 125 Leicester Road New Barnet in the County of Herts and the said Cyril Edgar Adams of 2 Ardilaun Road Highbury aforesaid (thereinafter called "the new Trustees") of the other part

That part of the devised hereditaments had been sold from time to time and the premises described in the Schedule thereto were the only hereditaments remaining the subject of such devise contained in the said Will.

That by virtue of the Law of Property Act 1925 the said John Packwood (the younger) and the said Ruth Adams became entitled to the said hereditaments as joint tenants upon the statutory trusts as defined by the said Act.

The Vendors in execution of the statutory trusts aforesaid & as Trustees thereby conveyed unto the Purchaser

ALL THOSE three messuages dwellinghouses and premises with the outbuildings barns yards and appurtenances to the same belonging situate and being Numbers 94, 96a and 96b Wellingborough Road Rushden aforesaid as the same were then or the late in the respective occupations
of --- Wood --- Thompson and --- Clayton

TO HOLD the same UNTO the Purchaser in fee simple freed and discharged from the said statutory trust for sale but SUBJECT to and with the benefit of the rights of way and drainage and other rights and easements as theretofore used and enjoyed in common with the owners and occupiers for the time being of the adjoining messuages Numbers 96, 98, and 100 Wellingborough Road aforesaid and Number 21 Moor Road AND SUBJECT also to the rights reserved to the Lord of the Manor of Rushden by the before abstracted Enfranchisement of the 14th February 1925.

ACKNOWLEDGEMENT with regard to the before abstracted probate of the Will of the said Ruth Adams deed that the transaction did not form part of the larger transaction.

BY THIS ASSENT dated the 15th day of June 1994 I DAVID REYNOLD HELM of Rushden in the County of Northampton as the personal representative of Ronald Joseph Page late of 94 Wellingborough Road Rushden in the County of Northampton ("the Deceased") do as such personal representative :

1.     assent to the vesting in MARY MARJORIE PAGE ("the Beneficiary") of 94 Wellingborough Road Rushden aforesaid of the property described in the Schedule to this Assent for an estate in fee simple

2.     acknowledge the right of the Beneficiary to production of the Grant of Probate of the Will of the deceased and to delivery of copies thereof

AS WITNESS the hands of the parties hereto the day and year first before written

THE SCHEDULE

ALL THAT the land and buildings known as 94 Wellingborough Road Rushden in the County of Northampton subject to and together with the benefit of the existing rights of way and drainage and other rights and easements as more particularly referred to in a Conveyance dated the 20th day of May 1946 and made between Henry Page of the one part and the Deceased of the other part
