Mortgage Deed

Register No 1522 - 8th February 1930

Mr William Norwood Ginns

To The Northampton Town and County Benefit Building Society

Mortgage of freehold property known as No 8 High Street South Rushden in the County of Northampton

This Mortgage Deed made the 8th day of February One thousand nine hundred and thirty between William Norwood Ginns of No. 8 High Street South Rushden in the county of Northampton Blacksmith a member of the Society hereinafter named (hereinafter called the Mortgagor) which expression shall include the personal representatives and assigns of the Mortgagor where the context so admits of the one part and The Northampton Town and County Benefit Building Society incorporated under the Building Societies Act 1874 and having its Chief Office at Number 85 Abington Street in the County Borough of Northampton (hereinafter called the Society which expression shall include the assigns of the Society where the context so admits) of the other part Witness as follow

1.     In consideration of the sum of Two hundred and seventy five pounds this day advanced by the Society to the mortgagor being the amount to which he is entitled according to the rules of the Society in respect of twenty eight shares held by him in the Society (the receipt whereof the Mortgagor hereby acknowledges) The Mortgagor hereby Covenants with the Society to pay to the Society the sum above mentioned so advanced by the Society to the Mortgagor as aforesaid by monthly instalments of not less than One shilling per share on or before the last day of each month and interest by monthly instalments at such rate and to be paid at such times as are provided in the rules of the Society or the resolutions of the Director for the time being on the said sum so advanced as aforesaid or the balance thereof from time to time owing by the Mortgagor to the Society And also to observe all the Rules for the time being of the Society

2.     For the consideration aforesaid the Mortgagor as Beneficial Owner hereby demises unto the Society All that dwellinghouse and smithy situate in and known as No. 8 High Street South Rushden aforesaid as the same are now in the occupation of the Mortgagor which said property was conveyed to the Mortgagor by a Deed of Conveyance bearing date the eighth of February One thousand nine hundred and thirty and made between John Todd of the one part and the Mortgagor of the other part Subject as to such part or parts thereof as was or were formerly Copyhold of the Manor of Rushden to such Manorial Incidents as were not extinguished by the Compensation Agreement dated the sixteenth day of March one thousand nine hundred and twenty nine and made between Charles Eustace Woolston of the one part and Caroline Mary Sartoris and Arthur Hugh Sartoris of the other part and subject to the right of the owners and occupiers of Nos. 4 and 6 High Street South aforesaid to use (a) The Common passage way lying between Nos. 6 and 8 High Street South aforesaid the site of which forms a portion of the property hereby demised (b) The Coal Barns W.C. and water tap situate on No. 8 High Street South aforesaid as the same are now used and enjoyed (c) The Common pathway at the rear of the property hereby conveyed leading from Nos 4 and 6 High Street South aforesaid to the said Coal Barns W.C. and water tap and the Gardens belonging to Nos 4 and 6 High Street South aforesaid the owners of Nos 4 and 6 High Street South aforesaid keeping the said Coal Barns and W.C. in repair and paying a moiety of the expenses of keeping the said Common passageway common pathway and water tap and the common drains and water pipes in repair To Hold the same unto the Society and its assigns for the term of Three thousand years from the date of this deed [the document then goes on to record the default agreement]

Written on the outside:
Memorandum 6th June 1955 By Conveyance of this date made between John William Brown and Roland Arthur Evans of the one part and James Joseph Guinee of the other part the said John William Brown and Roland Arthur Evans as the Personal representatives of the within named William Norwood Ginns deceased conveyed unto the said James Joseph Guinee the freehold Smithy with land at the rear situate in High Street South Rushden and his right to production of the within written Deed was thereby acknowledged.
