Conveyance - 1896 Mr John Shortland

From Mr Albert Franklin

Dated 11th August 1896. Mr Albert Franklin to Mr John Shortland CONVEYANCE of a plot of land situate at Rushden in the County of Northampton.

This Indenture made the eleventh day of August one thousand eight hundred and ninety six between Albert Franklin of Rushden in the County of Northampton builder (hereinafter called the Vendor) of the one part and John Shortland of the same place Shoe Sewer (hereinafter called the Purchaser) of the other part witnesseth that in consideration of the sum of one hundred and fifty pounds five shillings to the Vendor paid by the Purchaser on or before the execution of these presents (the receipt whereof the Vendor hereby acknowledges) The Vendor as the beneficial owner hereby conveys unto the Purchaser all that plot of land situate at Rushden aforesaid containing by recent admeasurement six hundred and nine square yards or thereabouts and having a frontage of fifty one feet to a certain new road now in the course of construction by the Vendor which said plot of land forms the south western portion of a larger plot of land numbered 5 and coloured pink on the map or plan drawn in the margin of a certain Indenture of enfranchisement bearing date the twelfth day of December one thousand eight hundred and ninety five and made between the Queen’s Most Excellent Majesty of the one part and Elliot Francis Barker of the other part together with the right at all times to use the said road now in the course of construction by the Vendor the Purchaser nevertheless paying from time to time a proportionate part with the other persons entitled to the use thereof of the expense of keeping such road in a proper state of repair to hold the same unto and to the rest of the Purchaser in fee simple subject to the exception and reservation contained in the said Indenture of enfranchisement of the mines minerals and mineral substances in or under the premises with full powers of working the same and other powers to which Her Majesty the Queen Her successors or assigns are or may be entitled but with the benefit of the right to compensation for injury thereby received and the Purchaser will forthwith erect and forever afterwards maintain a close fence not less than five feet in height along the eastern and southern boundaries of the plot of land hereby conveyed and will also observe a building line eight feet back from the road boundary. And the Vendor hereby acknowledges the right of the Purchaser to production of the Documents of Title mentioned in the Schedule hereto and to delivery of copies thereof and hereby undertakes for the safe custody thereof the witness whereof the said parties to these presents have hereunto set their hands and seals the day and year above written.
