8th May 1830 Absolute Surrender of a messuage from Ann Hewitt and William Hewitt to Mrs Mary Church

Whereas Jonathan Stevens late of Rushden in the County of Northampton Waggoner a Customary Tenant of the said Manor did in and by his last Will and Testament in writing duly executed and attested bearing date the twenty ninth day of March in the year One thousand eight hundred and fifteen Give and devise unto his sister Ann Hewitt The Messuage Tenement or Dwellinghouse and premises with the appurtenances hereinafter described and intended to be hereby surrendered and all other his real estate whatsoever To hold to her for and during the term of her natural life and from and after her decease Testator gave and devised the same unto his Nephew William Hewitt (then a Foot Soldier in his Majesty’s Service) and to his heirs and assigns in case his said Nephew should return to Rushden before the decease of his said Sister Ann Hewitt but if his said Nephew should not return to Rushden before the decease of his said Sister Ann Hewitt then Testator gave and devised the said Messuage or Tenement Orchard hereditaments and premises and every part thereof unto John Peacock of Rushden aforesaid Dissenting Minister and William Presland of Rushden aforesaid yeoman their heirs and assigns Upon trusts therin mentioned And Whereas the said William Hewitt returned to Rushden some years ago whereby he became intitled to the reversion and inheritance of the said Messuage Tenement or Dwellinghouse and premises expectant upon and to take effect in possession immediately upon the decease of his Mother the said Ann Hewitt the Devisee for life as aforesaid and who was duly admitted Tenant to the said Messuage Tenement or Dwellinghouse and premises at a Court holden in and for the said Manor on the ninth day of October in the year one thousand eight hundred and eighteen And Whereas Mary Church of Higham Ferrers in the County of Northampton widow hath contracted and egreed with the said Ann Hewitt and William Hewitt for the absolute purchase of the said Messuage Tenement or Dwellinghouse hereditaments and premises hereinafter particularly described and so devised to them by the said recited Will of the said Jonathan Stevens as aforesaid at or for the price or sum on One Hundred and sixteen pounds Now therefore be it remembered that on the eighth day of May in the year of our Lord one thousand eight hundred and thirty the said Ann Hewitt and William Hewitt in consideration of the Sum of One hundred and sixteen pounds of lawful money current in Great Britain to them in hand well and truly paid by the said Mary Church at or before the signing and passing of this surrender in full for the absolute purchase of the Messuage Tenement or Dwellinghouse hereditaments and premises hereby Surrendered the receipt whereof is hereby acknowledged Did out of court surrender by the Rod into the hands of Our Most Gracious Sovereign Lord King George the Fourth of the said Manor by the hands and acceptance of Griffith Roberts and John Corby two Customary Tenants of the said Manor according to the custom thereof and according to their respective Estates and interests in the premises All that Messuage tenement or Dwellinghouse situate and being in Rushden aforesaid near to the North side of the Church heretofore in the tenure or occupation of Peter Cooper then of William Moore afterwards of John Smith since of the said Jonathan Stevens late of the said Ann Hewitt and William Hewitt and is now in the tenure or occupation of Thomas Packwood Together with the entry or passage barn yard garden orchard and Homestead and all other the rights members privileges and appurtenances to the same premises belonging or in any wise appertaining And the reversion and reversions remainder and remainders yearly and other rents issues and profits thereof And also all the Estate right itile interest use trust property possession inheritance benefit claim and demand whatsoever of them the said Ann Hewitt and William Hewitt respectively out of in or to the said Messuage Tenement or Dwellinghouse hereditaments and premises hereby surrendered or intended so to be and every or any part or parcel thereof To the only proper and absolute use and behoof of the said Mary Church her heirs and assigns for ever at the Will of the Lord according to the custom of the said Manor
