Compensation Agreement - Manor of Rushden - In the County of Northmpton

An Agreement made the sixteenth day of March One thousand nine hundred and twenty-nine
Between Charles Eustace Woolston
Of Wellingborough in the County of Northampton
Steward of the above-mentioned Manor as Agent for the Chancellor of the
Duchy of Lancaster acting on behalf of His Majesty in right of the said Duchy
(Lord of the above-mentioned Manor) of the one part and Caroline Mary Sartoris
and Arthur Hugh Sartoris of Rushden in the County
of Northampton (the Owners of the land described in the
Schedule hereto formerly copyhold of the said Manor but now enfranchised
By virtue of the Law of Property Act 1922) of the other part.

Witnesseth as follows:-

1. Pursuant to the Law of Property Act 1922 it is agreed that the compensation for the extinguishments of the Manorial incidents saved by Part V. of that Act affecting the said land shall be the sum of Three Hundred and Eighty seven Pounds Fifteen Shillings and Four Pence (£387.15s.4d.) with interest thereon payable half-yearly at the rate of Five and a half Pounds per centum per annum from the date hereof until paid.

2. The Stewards compensation and all costs and expenses paid or incurred by the Lord and recoverable from the tenant in respect of this extinguishments have been included in the compensation money aforesaid.

Description of the land affected by the Manorial incidents.

All that plot of copyhold land or ground lying in Brook Field in Rushden aforesaid

Containing twenty acres three roods and thirty two perches as the same was on the late inclosure of the fields of Rushden aforesaid set out and bounded on the North East by the Lordship of Higham Ferrers on part of the East by the bondhold allotment on the said inclosure made to Thomas Eccles on part of the South and the remaining part of the East by the bondhold allotment on the said inclosure made to William Saby on the remaining part of the South by the Turnpike Road leading from Higham Ferrers to Wellingborough on the South West by the second copyhold allotment on the second inclosure made to Thomas Richards (not in settlement) and on all other parts thereof by the freehold allotment to the Marquis of Rockingham And Also a plot of bondhold land or ground lying in the said Brook Field in Rushden aforesaid containing one acre two roods and eleven perches as the same was on the said inclosure admeasured and set out and bounded on the East by the said bondhold allotment on the said inclosure made to the said Thomas Eccles on the South by the Turnpike Road leading from Higham Ferrers to Wellingborough and on the West and North by the said copyhold allotment made to the said William Saby Except such portion two acres in extent abutting on the said Turnpike Road of the said last mentioned plots of land as was enfranchised by Indenture dated the twenty ninth day of December One thousand eight hundred and ninety six and which said plots of land now form four inclosures formerly in the occupation of George Henry Skinner and now of John Beaty and are numbered 404, 405, 408 and 409 on the Ordnance Map for the Parish of Rushden 1/2500 scale 1886 Edition (except a portion of Number 405 containing one acre and three roods sold to John Smith Mason) And Also the site of All That copyhold or customary messuage or tenement with the homestead barn stable pightle of old inclosure and appurtenances situate and being in Rushden aforesaid containing by estimation one acre or thereabouts (more or less) And Also All That close of pasture or enclosed ground adjoining or near thereto containing ten and a half acres or thereabouts (more or less) numbered 241 on the said Ordnance Map being one of two closes containing altogether fifteen acres all which premises were formerly in the several occupations of William Codgbrook Henry Knighton and John Elson afterwards of Thomas Leigh Thomas Knight Thomas Hopkins and Jeremiah Marchant their undertenants or assigns and then late of John William Barrington Browne and which said close of pasture land was late in the occupation of Charles Edwin Knight and now of R Wheeler And Also All That messuage or tenement situate in Rushden aforesaid together with the tan yard outhouses buildings sheds tan pits and appurtenances thereunto belonging formerly in the tenure of the said William Codgbrook and then or late of the said Thomas Leigh then of Jeremiah Knight and now of A Bird forming part of number 126 on the said Ordnance Map and numbered 54 higham Street South And Also All That messuage or tenement with the appurtenances situate and being in Rushden aforesaid on the South end thereof then late in the tenure or occupation of Benjamin Baker and then or then late of the said Thomas Knight then of Walter Lewis and now of H Lewis also forming part of Number 126 on the said Ordnance Map and numbered 56 high Street South And Also All That other messuage adjoining also forming part of Number 126 on the said Ordnance Map formerly in the occupation of Thomas Childs and numbered 58 High Street South but now partly demolished And Also All That messuage or tenement occupied as two tenements with the orchard Pightle outhouses and premises thereto belonging and adjoining and therewith occupied situate and being in Rushden aforesaid formerly in the tenure or occupation of Joseph Curtis and his undertenants and the said Thomas Leigh and then or then late of the said Joseph Curtis and John William Barrington Browne then in the respective occupation of A Stokes and J M Page and also forming part of Number 126 on the said Ordnance Map and numbered 52 and 50 High Street South but now known as Number 59 High Street South And Also All That close of pasture and enclosed ground containing four and a half acres (more or less) numbered 248 on the said Ordnance Map being one of two closes containing altogether fifteen acres which said premises were formerly in the several tenures or occupations of the said William Codgbrook Henry Knighton and John Elson and afterwards of the said Thomas Leigh Thomas Knight Thomas Hopkins and Jeremiah Marchant their undertenants or assigns and were then late in the tenure or occupation of the said John William Barrington Browne and which said close of pasture or enclosed ground was late in the occupation of the said Jeremiah Knight and now of the said Arthur Hugh Sartoris And Also All That messuage or tenement and premises situate and being in Rushden within the said Manor formerly in the occupation of Mark Lilley and afterwards divided into two messuages or tenements and occupied by Ann Baker and Thomas Baker respectively but which said premises had since been again united and then consisted of a messuage or cottage butcher’s shop garden ground and other hereditaments and were formerly in the occupation of George Skinner as tenant thereof and afterwards of the said George Henry Skinner and now of Herbert Skinner and form part of Number 280 on the said Ordnance Map and numbered 2 High Street South And All That messuage or tenement and premises with the close adjoining situate and being in High Street in Rushden aforesaid in the occupation of Ann Barry deceased but then of --- Colson as tenant thereof which messuage is now pulled down and there is erected on the site three messuages known as Number 40, 42 and 43 High Street South and also a building known as the Conservative Club which said premises form part of Number 126 on the said Ordnance Map And All That messuage or tenement commonly called or known by the sign of the Swan Public House with the barn stable outbuildings yard and appurtenances thereto belonging also situate and being in Rushden aforesaid and in the occupation of John Corby which said premises were afterwards known by the name or sign of the Coach and Horses Public House and were in the occupation of George Feazey as tenant thereof but are now known as number 16 High Street South formerly in the occupation of William Hollis and now of A Okins and form part of Number 280 on the said Ordnance Map And All That messuage or tenement with the Blacksmith’s Shop shed barn and appurtenances adjoining and belonging thereto also situate and being in Rushden aforesaid formerly in the occupation of John Morris then of William Facer afterwards of Samuel Tyrrell and then of Adam Ginns and now of W N Ginns Together with two other messuages adjoining sometime since erected on part of the ground belonging to such last mentioned messuage formerly in the respective occupations of Mrs Moore and Joseph Green and now of H Bozet and Mrs Barley and which last mentioned three messuages are known as Numbers 8, 6 and 4 High Street South and form part of Number 280 on the said Ordnance Map And All That messuage or tenement and Grocer’s shop with the warehouses barns stables orchard or Pightle of old inclosure and appurtenances thereto adjoining and belonging also situate and being in Rushden aforesaid formerly in the occupation of Thomas Scarborough then of James Averill afterwards of Josiah Parker since of Robert Octavius Butcher and then of Thomas Brown and now of A Simpson known as number 22 High Street South And Also All That messuage or tenement formerly occupied as a Carpenter’s Shop with the barn garden and appurtenances thereto adjoining and belonging also situate and being in Rushden aforesaid formerly in the occupation of James Colson afterwards of William Clark but then of William Thompson as teneant thereof which said messuage was some years since pulled down and two messuages erected on the site thereof now known as Numbers 46 and 48 High street South formerly in the respective occupations of William Henry Brown and George Robert Clayton and now of A J Sturgess and George Robert Clayton and form part of Number 126 on the said Ordnance Map And Also All That close or ancient inclosure in Rushden aforesaid commonly called Cordwell Close containing about one acre and thirty eight perches And Also All That plot or allotment of land lying in Brookfield and the Meadow in Rushden aforesaid containing forty eight acres and twenty eight perches or thereabouts (more or less) as the same was upon the division and enclosure of the common and open fields of Rushden aforesaid admeasured and set out (exclusive of all roads and ways in and over the same) bounded on part of the North by the River Nine or Nene on part of the East by the freehold allotment on the said enclosure awarded to the Marquis of Rockingham on part of the South on another part of the East and another part of the North by the fifth copyhold allotment on the said inclosure awarded to Matthew Shipton on the North by the said freehold allotment to the said Marquis of Rockingham on the North East by the copyhold allotment on the said inclosure awarded to William Saby on other part of the South by the Turnpike Road leading from Higham Ferrers to Wellingborough on part of the West on other part of the South and remaining part of the East by the said old enclosure called Cordwell Close hereinbefore described on the remaining part of the South by the said Turnpike Road and on the South West South East and West by the second copyhold allotment on the said inclosure awarded to Thomas Fletcher which said ancient enclosure and plot or allotment of land hereinbefore respectively mentioned and described were sometime since (for many years) divided and made into and used and occupied as five several closes pieces or parcels of land which by admeasurement were found to contain altogether fifty acres and fifteen perches (more or less) and were then divided into and occupied as six closes pieces or parcels of land and the same were sometime since in the occupation of John Crisp and afterwards of Walter Rokesby and were then in the tenure or occupation of Frederick Urban Sartoris Except such portion (three acres two roods and thirteen perches in extent abutting on the said Turnpike Road) of the said last mentioned plot of land as was enfranchised by Indenture dated the twenty ninth day of December One thousand eight hundred and ninety six and which said plots of land now form five inclosures formerly in the occupation of the said George Henry Skinner and now of the said John Beaty numbered 381, 383, 406, 407 and 413 on the said Ordnance Map And Also All so much and such part or parts as is or are of copyhold tenure of All That messuage or tenement or farmhouse with outbuildings and appurtenances and closes of land thereto belonging or therewith occupied situate lying and being in the Parish of Rushden aforesaid then or late called or known by the respective names and containing by admeasurement the respective quantities thereinafter contained were the same several quantities a little more or less that was to say the Farm House and Homestead one acre and ten perches Road Close seven acres one rood and thirty eight perches Long Close two acres one rood and twenty two perches Home Close four acres one rood and thirty four perches  The Fourteen Acres thirteen acres three roods and eighteen perches Top Thirteen Acres thirteen acres and twenty two perches Bottom Thirteen Acres thirteen acres two roods and thirty two perches

 The Twelve Acres twelve acres and twelve perches and The Nineteen Acres nineteen acres and ten perches and containing altogether eighty seven acres and thirty eight perches or thereabouts (of which said closes of land portions containing together thirty eight acres one rood and ten perches formed the freehold allotment on the said inclosure awarded to Jonathan Baker and comprising the properties numbered 266 and 267 and parts of the properties numbered 268 and 269 on the said Ordnance map) And Also All That messuage or dwelling house with the workshop and other outbuildings garden ground and appurtenances thereto belonging and the paddock or parcel of land thereto adjoining situate in the said Parish of Rushden which said messuage garden ground and piece or parcel of land contained together  two roods and seventeen perches were the same more or less bounded on the South by land of the said Frederick Urban Sartoris on the East by the Village Street of Rushden aforesaid and on the West by land firstly hereinbefore described except such portion (one hundred and fifty eight square yards in extent on the Eastern boundary of Road Close) as was sold and surrendered to John and Charles Claridge in the year one thousand eight hundred and ninety five and which said Farm House and closes of land lastly hereinbefore mentioned were formerly in the occupation of the said George Henry Skinner and now of the said John Beaty and numbered 264, 265, 266,  267, 268, 269 and 270 on the said Ordnance map (except a portion of Number 270 contained in a Compensation Agreement dated the eighteenth day of March One thousand nine hundred and twenty six) And Also All Those three several closes pieces or parcels of land adjoining each other situate in the said parish of Rushden bounded on the north west by other land or the said Frederick Urban Sartoris on the south east by the road leading from Wimmington to Rushden aforesaid and on the north east by the road leading through Rushden aforesaid from Bedford to Wellingborough and which said three several pieces or parcels of land contained respectively four acres three roods and twenty six perches six acres three roods and thirty five perches and five acres and two roods or thereabouts more or less which said three closes of land are now occupied as four closes formerly by  Jeremiah Knight Charles Ernest Bayes and Charles Edwin Knight respectively and now by Messrs. Dickens and Waller  H Skinner and R  Wheeler and are numbered 115, 257, 247 and 246 on the said Ordnance map And Also twelve formerly eleven cottages known as numbers 7, 9, 11, 13, 15, 17, 19, 21, 23, 25, 25a and 27 Duck Street adjoining number 29 Duck Street and built on land formerly belonging thereto by Frederick Urban Sartoris since deceased And Also four messuages likewise built on land belonging to the said messuage and now known as the Almshouses numbered 32 and 34 Wellingborough road And Also two other messuages likewise built on the said land belonging to the first mentioned messuage known as numbers 28 and 30 Wellingborough Road formerly in the respective occupations of Frank Roads and P G Packer and now of Mrs. Bailey an W N Ginns the whole of which said his son Joseph Brown late of the said John Mason and then or late of Michael Mason or howsoever otherwise the said closes or inclosed grounds were abutted bounded known or distinguished which said two closes were numbered 69 and 238 on the said Ordnance map And Also All That messuage tenement or farmhouse with the yard barns stables and outbuildings and piece of garden ground thereto adjoining situate at Rushden aforesaid lying on the west (formerly stated to be East) side of and adjoining to the road leading from Higham Ferrers to Bedford and lately in the occupation of William Flawn then of George Skinner and now of Frank Knight And Also All That other messuage cottage or tenement with the yard outbuildings and piece of garden ground thereto belonging adjoining the last mentioned messuage and also lying along the said road leading from Higham Ferrers to Bedford and lately in the occupation of John Hilson then of the said George Skinner and now of the said Frank Knight but now forming part of the farm buildings to the said first mentioned farmhouse And Also All That close or piece or parcel of pasture land adjoining the said messuages and containing by admeasurement one acre three roods and three perches (were the same more or less) and lately in the occupation of the said William Flawn then of the said George Skinner and now of the said Frank Knight And Also All That other close or piece or parcel of pasture land containing by admeasurement (were the same more or less) adjoining the said above described premises and lately also in the occupation of the said William Flawn then of the said George Skinner and now of the said Frank Knight And Also All That close or piece or parcel of pasture land containing by admeasurement four acres and fifteen perches adjoining the last mentioned close and lately in the occupation of James Rootham then of the said George Skinner and now of the said Frank Knight except such part thereof containing one rood and twenty one perches and eleven yards as was sold off and surrendered by the said Frederick Urban Sartoris in his lifetime namely on the thirty first day of March one thousand eight hundred and seventy one to Henry William Corrie Esquire And Also All That other close or piece or parcel of pasture land then divided into and occupied as two parts or closes containing by admeasurement twelve acres and five perches (were the same more or less) adjoining the said last mentioned close and lately in the several occupations of the said James Rootham and the said George Skinner then the said George Skinner and now of the said Frank Knight And Also All That other close piece or parcel of arable land containing by admeasurement ten acres and twenty one perches (were the same more or less) adjoining the last mentioned close formerly in the occupation of the said George Skinner and now of the said Frank Knight And Also All That other close or piece or parcel of arable land containing by admeasurement fourteen acres and twenty six perches (were the same more or less) adjoining the said last mentioned close formerely in the occupation of the said George Skinner and now of the said Frank Knight and also all that other close or piece or parcel of arable land containing by admeasurement fifteen acres two roods and fifteen perches (were the same more or less) adjoining the said two last mentioned closes and lying along the road leading from Higham  Ferrers to Bedford and lately in the occupation of the said John Hilson then of the said George Skinner and now of various tenants together with the eight cottages erected thereon by the said Frederick Urban Sartoris deceased formerly in the occupation of Luke Green Charles Twelvetree W Leach  S Knight George Willmott  R Sharpe  N Hanger and one unoccupied and now or late in the occupation of George William Hanger and others And also all that other close or piece or parcel of arable land containing by admeasurement nineteen acres one rood and thirty two perches (were the same more or less) adjoining the said two last mentioned closes and also lying along the said road and lately in the occupation of the said James Rootham then of the said George Skinner and now of the said Frank Knight except such portion (two acres in extent on the Southern extremity) as was enfranchised in the year one thousand eight hundred and ninety five and conveyed to the Rushden Urban District Council and which said farmhouse and closes of land and cottages lastly hereinbefore mentioned are numbered 112, 97, 94, 70, 68, 50, 67, 73, 51 and 49 on the said Ordnance map And Also All That close piece or parcel of inclosed land or ground with the appurtenances lying and being in the Parish of Rushden aforesaid adjoining the public road leading from Rushden aforesaid to Wymington heretofore reputed to contain twenty four acres or thereabouts subsequently twenty five acres and thirty one perches or thereabouts but by a recent admeasurement thereof found to contain twenty six acres and twenty eight perches or thereabouts formerly in the occupation of Edward Wood or his undertenants since then of Messieurs Codgbrook and Knighton afterwards of Sargeant Darnell and subsequently of Susannah Manning widow of John Daniel Manning which said close piece or parcel of enclosed land or ground was sometime since divided into and was then used and occupied as two closes one of which was arable and was lately reputed to contain seventeen acres one rood and fourteen perches or thereabouts but by a recent admeasurement thereof had been found to contain eighteen acres one rood and seven perches or thereabouts and the other pasture and was lately reputed to contain seven acres three roods and seventeen perches or thereabouts but by a recent admeasurement thereof had been found to contain seven acres three roods and twenty one perches or thereabouts both of which two closes were formerly in the occupation of Thomas Lawton his undertenants or assigns then in  the occupation of Edward Farrow and now in the occupation of Frank Abbott together with the two cottages or tenements and barn lately erected and built by Mary Odell on a portion of the South end part of the said close of pasture containing seven acres three roods and twenty one perches formerly in the respective occupations of the said Edward Farrow and Widow Farrow then of Thomas Clayton and his undertenants and now of Frank Abbott or his undertenants bounded on the South East by the said public road and lands belonging to the Bailiff of Rushden Court on the South West by the said last mentioned lands and the Lordship of Wymington aforesaid and on the North West and North East by land belonging to the said Frederick Urban Sartoris which last mentioned closes of land are numbered 234, 235, 236, 237 and 242 on the said ordnance map To All which said hereditaments hereinbefore described the said Caroline Mary Sartoris and Arthur Hugh Sartoris were admitted tenants out of court on the fourth day of may one thousand nine hundred and seven devisees in trust for sale under the will of Herbert Sartoris deceased And All which said hereditaments hereinbefore described are delineated on the three plans attached hereto and thereon coloured pink.
