Manor of Rushden - 1828

Copy of Admission of Bryan STEVENS and William TAILBY
under the will of Richard STEVENS deceased

9th May 1828 – Manor Court held before Charles Havey HODSON Gentleman Deputy Steward to Edward BOUVERIE Esquire Steward of the said Manor.

At this Court it was found and presented by the Homage that Richard STEVENS late of Rushden aforesaid farmer deceased late one of the Customary Tenants of the said Manor who whilst he lived held to him and his heirs of the Lord of the said Manor by fealty suit of Court and the several yearly rents of two pounds eighteen shillings and ten pence and seventeen shillings and eight pence All that Messuage Tenement or Farmhouse and Homestead with the Close of Pasture and appurtenances thereunto adjoining and belonging situate and being in the North end of Rushden aforesaid And also all that one close of pasture ground lying and being in the North end of Rushden aforesaid late Mary MASON North and late Richard WARD on the South And also one other close lying in the North end of Rushden aforesaid late John GOBBY South And also the site of ground whereon a messuage or tenement formerly stood and close of pasture adjoining to the same in Rushden aforesaid late John DENTON North and late Thomas MALLERY on the South And also all that Pightle little close or orchard adjoining to and formerly belonging to the dwelling house of Thomas WARD in Rushden aforesaid And also all that ancient inclosure in the town of Rushden aforesaid bounded on the South by an old inclosure lately belonging to Samuel MEE upon the late division and inclosure of the common and open fields meadows and commonable lands in the parish of Rushden aforesaid exchanged with Richard STEVENS deceased the  of the said first name Richard STEVENS and on the North by an old inclosure now or late belonging to John WRIGHT containing two roods and fourteen perches late the property of Benjamin KIDNEY Esquire and by the award of the Commissioners made and executed upon the said division and inclosure assigned awarded and appointed unto the said Richard STEVENS the  in lieu of and in exchange for the third copyhold allotment awarded to the said Richard STEVENS the  containing three roods and six perches which the said Commissioners did assign award and appoint unto the said Benjamin KIDNEY for such exchange as aforesaid And also all that close of ancient inclosure adjoining to the farm homestead of the said Richard STEVENS bounded on the South and North by the said last described ancient inclosure containing two roods and twenty eight perches late the property of the said Samuel MEE and by the said award assigned awarded and appointed unto the said Richard STEVENS the  in lieu of and in exchange for the fourth copyhold allotment awarded to the said Richard STEVENS the  containing three roods and twenty six perches which the said Commissioners did assign award and appoint unto the said Samuel MEE for such exchange as aforesaid And also all that plot of copyhold land or ground lying in a certain field in the parish of Rushden aforesaid now before or at the time of the said division and inclosure called Black Fen field containing one acre as the same was then admeasured and set out and bounded as in the said award is mentioned Which said plot of land or ground was by the said award set out allotted and awarded to Margaret MALLERY and was with the consent of the said Margaret MALLERY assigned awarded and appointed unto the said Richard STEVENS the  in lieu of and in exchange for a close of ancient inclosure called Broadwell Close

Containing one acre and eight perches the property of the said Richard STEVENS the  which the said Commissioners did assign award and appoint unto the said Margaret MALLERY for such exchange as aforesaid And also all that plot of bondhold land or ground lying in Black Fen field aforesaid containing fifty acres as the same was upon the said division and inclosure admeasured and set out and bounded as in the said award is mentioned And also all that plot of copyhold land or ground lying in Black Fen field aforesaid containing twenty nine acres three roods and eight perches as the same was upon the said division and enclosure admeasured and set out and bounded as in the said award is also mentioned And also all that other plot of other copyhold land or ground lying in certain places in the parish of Rushden aforesaid now before or at the time of the said division and inclosure called the Meadow and Brook field containing twenty five acres one rood and twenty eight perches as the same was then admeasured and set out and bounded as in the said award is also mentioned All which said premises were late in the possession tenure or occupation of the said first named Richard STEVENS deceased and are now in the possession tenure or occupation of Michael MASON and to which the said first named Richard STEVENS was admitted tenant at A Court held in and for the said Manor on the thirteenth day of June in the year of our Lord one thousand eight hundred as the Devisee in fee thereof named in and by the last will and testament of his said  the said Richard STEVENS died sometime since seized thereof  And it was further found and presented by the Homage that the said first named Richard STEVENS in and by his last will and testament in writing bearing date the sixteenth day of November one thousand eight hundred and sixteen gave and devised all and every his real and personal estate and effects whatsoever and wheresoever unto his brother Bryan STEVENS of Hallerton in the County of Leicester grazier and William TAILBY of Humberstone in the said County of Leicester grazier To hold to them their heirs executors administrators and assigns forever according to the natures qualities and tenures of the said estates respectively To for and upon the several uses trusts ends intents and purposes in his said will mentioned expressed and declared of and concerning the same NOW to this Court came the said Bryan STEVENS in his own proper person and the said William TAILBY by Henry Matthew HODSON of Wellingborough in the said County of Northampton gentleman his Attorney and humbly prayed of the Lord of the said Manor to be admitted tenants to the said messuage tenement or farmhouse closes plots or allotments of land or ground and premises so devised to them as aforesaid To whom the Lord of the said Manor by his aforesaid Deputy Steward hath granted seisin thereof by the rod To have and to hold the said messuage tenement or farmhouse closes plots or allotments of land or ground and premises with their appurtenances unto the said Bryan STEVENS and William TAILBY their heirs and assigns forever according to the purport and effect of the said will of the said first named Richard STEVENS deceased at the will of the Lord according to the custom of the said Manor by fealty suit of court fines rents and other customs and services anciently due and of right accustomed and for such their admission they have given unto the Lord for a fine as appears in the margin and so saving always the right of the Lord and of all persons whomsoever the said Bryan STEVENS and William TAILBY were admitted tenants in manner aforesaid but their fealty was respited because &c
