Jonathan Stevens – will 1815

This is the last Will and Testament of me Jonathan Stevens of Rushden in the County of Northampton Waggoner which I do make publish and declare in manner following, that is to say

First I will and direct that my just Debts and Funeral Expenses be fully paid and satisfied by my Executors hereinafter named – I give and bequeath unto my Brother John Hewitt all my Linen and Wearing Apparel – And to each of my two Nieces Martha Clayton and Sophia Randall the sum of Ten Pounds – I Also give and bequeath all the rest residue and remainder of my personal property and effects whatsoever and wheresoever the same may be or consist of To my Sisters Ann Hewitt and Mary Stevens in equal shares and proportions – I Give and devise unto my said Sister Ann Hewitt All that my Messuage Tenement or Dwellinghouse, Orchard, Yard, Garden, Outbuildings and Appurtenences thereto belonging situate in Rushden aforesaid and all other my Real Estate wheresoever the same may be situate To hold to her for and during the term of her natural life and from and after her decease I Give and Devise the same unto my Nephew William Hewitt (now a Foot Soldier in his Majesty’s Service) and to his Heirs and Assigns in case he my said Nephew shall return to Rushden before the decease of my said sister Ann Hewitt but if my said Nephew shall not return to Rushden before the decease of my said Sister Ann Hewitt Then I give and devise the said Messuage or Tenements Orchard Hereditaments and Premises and every part thereof unto John Peacock of Rushden aforesaid Dissenting Minister and William Presland of Rushden aforesaid Yeoman their Heirs and Assigns Upon Trust that they the said John Peacock and William Presland or the Survivor of them or the Heirs of such Survivor do and shall as soon as conveniently may be after the decease of my said Sister Ann Hewitt Sell and dispose of the said Hereditaments and Premises either by Public Auction or Private Contract and for the best price that can be obtained for the same and upon further Trust that they the said John Peacock and William Presland and the survivor of them or the Heirs Executors or Administrators of such Survivor do and shall pay, apply and dispose of the Money to arise from such sale Unto and amongst my four Cousins Samuel Stevens, Robert Stevens, Thomas Stevens and Jonathan Stevens in equal Shares and Proportions and in the case of the death of either of my said four Cousins in the life time of my said Sister Ann Hewitt leaving lawful Issue then I will and direct that the Share or Shares of him or them so dying shall go and be paid to such Issue, if more than one, in equal Shares and Proportions and if but one, then the whole to such one when and as he she or they shall attain his her or their Ages of Twenty one Years and that the Interest thereof shall in the mean time be paid and applied for his, her and their use and benefit But in case of the death of either of my said four Cousins in the lifetime of my said Sister Ann Hewitt without having lawful Issue then I direct that the Share or Shares of him or them so dying without such Issue shall go and be paid to the Survivor or Survivors of them in equal Shares and Proportions And I do hereby give and bequeath the same accordingly – And I do hereby declare that the receipt or receipts of them the said John Peacock and William Presland or the survivor of them or the Heirs of such Survivors shall be good and sufficient discharges to the Purchaser or Purchasers of the said Hereditaments and Premises hereby directed to be sold for so much Money as in such Receipt or Receipts shall be expressed to be had and received And that such Purchaser or Purchasers shall not be bound to see to the application of such Purchase Money or be answerable or accountable for the misapplication or non application thereof or of any part thereof And Lastly I do hereby nominate and appoint the said John Peacock and William Presland Executors of this my last Will and Testament In Witness whereof I the said Jonathan Stevens the Testator have hereunto set my Hand and Seal the twenty ninth day of March in the Year of our Lord one thousand eight hundred and fifteen.
