Sarah Ann SANDERS - 1844 Will

Dated 30th of April 1841

This is the last Will and Testament of me Sarah Ann SANDERS of Rushden in the County of Northampton Widow which I do make publish and declare as follows, that is to say I appoint my friend John WARD of Grendon in the said County of Northampton Farmer and Grazier sole Executor of this my Will and I give to the said John WARD the sum of ten pounds as an acknowledgement for the trouble he will have in the execution thereof. I desire to be buried near to the remains of my late husband and that an inscription to my memory may be put upon a space left for that purpose upon the Tombstone of my said late husband. I give unto Timothy ROBERTS son of my late uncle John ROBERTS the sum of forty pounds and my silver pint mug if the said Timothy ROBERTS should die in my life time or before the said legacies shall be become payable then I direct the legacies so given shall be disposed of as follows that is to say – the said forty pounds to be divided equally between the children of the said Timothy ROBERTS and the silver pint mug to his son Sanders ROBERTS. I give unto Biddy BALLANTYNE wife of William BALLANTYNE daughter of my late Aunt Catherine TESTER the sum of forty pounds and in case the said Biddy BALLANTYNE should happen to depart this life in my life time or before the said legacy shall become payable then I give her said legacy or sum of forty pounds unto her said husband William BALLANTYNE and in case the said William BALLANTYNE shall be then dead and leave no lawful issue then I direct that the said legacy shall sink into the residue of my personal estate. I give unto Elizabeth GROSS, Sarah GROSS, and Mary HALL daughters of my Cousin Mary GROSS as follows that is to say I give unto Elizabeth GROSS one pair of sheets two pillow cases my largest set of drawers and a Swing glass. Unto Sarah GROSS I give the small set of drawers in my room my striped bed in which I sleep together with the bedding & furniture thereof one pair of sheets two pillow cases and unto Mary HALL I give one pair of sheets and two pillowcases I also give unto Mary BUTLER daughter of my cousin Elizabeth BUTLER one pair of sheets and two pillow cases The dressing table and swing glass upon it and the small set of drawers in my sleeping room. I give unto Elizabeth RYE daughter of John and Mary RYE one silver table spoon marked S.A.S. and unto Sarah CORBY another daughter of the said John and Mary RYE I give the sum of Ten pounds, my silver cream jug and six silver tea spoons and sugar tongs all marked S.A.S. And unto Mary RYE another daughter of the said John and Mary RYE I give one silver table spoon marked C.S. And to Amy RYE another daughter of the said John and Mary RYE I give one silver table spoon without a mark – And if either of them the said Elizabeth RYE, Sarah CORBY, Mary RYE and Amy RYE shall happen to die in my life time I direct that the bequests so made to such of them so dying shall go to the survivors or survivor of them if more than one to be divided equally between them I give and bequeath all my wearing apparel unto Hannah KNIGHT wife of Samuel KNIGHT, the said Mary GROSS wife of William GROSS the said Elizabeth BUTLER wife of Thomas BUTLER the said Mary RYE wife of the said John RYE and Elizabeth COLSON widow to be equally divided between them share and share alike and in case any or either of them shall happen to die in my life time I give and bequeath the share or shares of her or them so dying unto their or her children to be equally divided between them if more than one share and share alike. I give the Watch which belonged to my late husband unto William Sanders BAKER son of William and Elinor BAKER, and if he should die in my life time leaving a son or sons I give the said watch unto the eldest son of the said William Sanders BAKER Also I give unto the said Biddy BALLANTYNE my best tea chest and one set of china All the residue and remainder of my household goods and furniture plate linen and china (not herein before by me otherwise disposed of) I give and bequeath unto the said Hannah the Wife of the said Samuel KNIGHT And in case she shall die in my life time unto all her daughters living at her decease to be equally divided amongst them share and share alike And in case I shall have any money out at Interest at the time of my decease I give and bequeath the same and the securities for the same unto the said Hannah KNIGHT Mary GROSS Elizabeth BUTLER and Susannah PERCOX daughter of my late cousin John SABY to be equally divided between and amongst them share and share alike And in case any or either of them shall die in my life time I direct that the share or shares of her or them so dying shall go to the survivors in equal shares and proportions I desire that the female Servant who may be living with me at the time of my decease may be furnished and provided with decent mourning and her full years wages let my death happen when it may I give and devise unto the said John WARD All and singular my messuages lands tenements hereditaments and real estates situate lying and being at Rushden aforesaid or elsewhere And also all the rest and residue of my personal estate and effects whatsoever and wheresoever To Hold the same and every part thereof unto and to the use of the said John WARD his heirs executors administrators and assigns according to the natures and tenures of the same respectively Upon Trust that he the said John WARD his heirs executors or administrators do and shall as soon as conveniently may be after my decease sell and dispose of all and every my said real and personal estate and effects (not hereinbefore by me otherwise disposed of) or such parts thereof as shall not consist of money by public sale, by Auction or by private contract and together or in parcels as he or they shall think proper. And my Will is and I do hereby declare that the reciept of the said John WARD or his heirs, executors or administrators for the purchase money for the said messuages lands tenements hereditaments and real estates shall be a good and sufficient discharge to the said purchaser or purchasers thereof. And that such purchaser or purchasers after attaining such reciept shall not be obliged to see to the application of such purchase monies or any part thereof or be in any wise answerable or accountable for the loss, misapplication or nonapplication thereof or any part thereof. And I do hereby further declare that the said John WARD his executors and administrators shall stand and be possessed of the monies to arise from my said real estates and the residue of my personal estate Upon Trust in the first place to pay and discharge thereout all my just debts the legacies by me before bequeathed and my funeral and Testamentary expenses and after payment and satisfaction thereof Upon further Trust to pay distribute and divide all the residue of the monies to arise aforesaid unto between and amongst the said Hannah KNIGHT, Mary GROSS, Elizabeth BUTLER, daughters of my cousin William SABY deceased Susannah PERCOX, All and every the child and children of John SABY deceased the son of my late cousin John SABY also deceased (such child or children to take a parents share only) Sarah BOVE widow daughter of my cousin Thomas SABY deceased (now or lately residing in St Trinidad in the West Indies) and Frances the Wife of Thomas LITCHFIELD the daughter of my late Aunt Ann POOLE deceased in equal shares and proportions And in case any of them shall be then dead leaving issue Upon Trust to pay the share or shares of him her or them so dying unto their child or children equally but if any or either shall be then dead leaving no issue Upon Trust to pay the share or shares of him her or them so dying unto the survivors or survivor of them in manner aforesaid in equal shares and proportions And I direct that notice of my hereinbefore mentioned bequest be given to the said Sarah BOVE if living at the time of my decease and in case she is living at the time of my decease and resident in any part of the world not Great Britain and in the event of her not returning and making her claim for the above mentioned legacy or bequest within Two Years from the time of my decease then I direct that the share so allotted in the hereinbefore mentioned bequest be given to Angelina daughter of the said Sarah BOVE if she should be living In case neither of the said Sarah BOVE nor Angelina her daughter aforesaid be living at the time of my decease or the said Angelina dying and leaving no issue residing in any part of the World not in Great Britain then I direct that the share of her or them so bequeathed as above if unclaimed within Two Years and Six months from the time of my decease be divided between and amongst the said Hannah KNIGHT Mary GROSS Elizabeth BUTLER – Susannah PERCOX the child or children of my cousin John SABY – deceased Son of my late cousin John SABY also deceased (such child or children to take a parents share only) and Frances LITCHFIELD in manner aforesaid in equal shares and proportions And in case any or either of them shall be then dead leaving issue Upon Trust to pay the share so unclaimed unto the child or children or them so dying he her or them to take a parents share in equal shares and proportions but if any or either of them shall be then dead and leaving no issue Upon Trust to pay the share so unclaimed unto between and amongst the survivors or survivor of them in manner aforesaid in equal shares and proportions And I declare that the said John WARD his heirs executors or administrators shall be charged and chargeable only with and for such monies as he or they shall actually recieve by virtue of the trusts aforesaid nor shall be or they answerable or accountable for any casual or involuntary loss which may happen of the said trust property or any part thereof so as the same happen without his or their wilful neglect or default. And that the said John WARD his executors or Administrators shall and may by and out of the said trust properly deduct and retain to himself and themselves all such costs damages charges and expenses as he or they shall or may sustain or be put unto in or about the execution of this my Will or in any wise relating thereto And hereby revoking and making void all former Wills and Codicils by me at any time heretofore made I do declare this present writing to be and contain my only true last Will and Testament In Witness whereof I the said Sarah Ann SANDERS the Testatrix have to this my last Will and Testament Contained on Six sheets of paper set my hand and affixed my seal (to wit) my hand to the Five preceding Sheets and my hand and seal to this Sixth and last sheet thereof this Thirtieth day of April in the year of our Lord one thousand eight hundred and forty one

On the Third day of July 1844 John WARD of Grendon in the County of Northampton Farmer and Grazier the Sole Executor named in the within written will was then Sworn well and faithfully to fulfil the same according to law and that the goods chattels and credits of the within named deceased at the time of her death (which happened on the Ninth day of May 1844) did not amount to the sum of Two hundred pounds
