John MASON - 1829 Will

Will dated 12th Sep 1821

This is the last Will and Testament of me John MASON of Rushden in the County of Northampton Victualler which I do make publish and declare in manner following (that is to say) I give and devise unto my Son Michael MASON All and every my freehold and customary or copyhold messuages lands tenements and hereditaments and all other my real estate whatsoever situate lying and being in the Parish of Rushden aforesaid or elsewhere in the United Knigdom of Great Britain and Ireland with their and every of their appurtenances To hold the same and every part thereof unto and to the use of my said son Michael MASON his heirs and Assigns for ever Subject nevertheless to and charged and chargeable with and I do hereby expressly charge and make subjest All and singular the said hereditaments and premises hereinbefore devised to and with the Payment of several Legacies hereinafter by me given and bequeathed (that is to say) unto my son john MASON the Legacy or Sum of eight hundred Pounds unto my Daughter Elizabeth SMITH Widow the Legacy or Sum of four hundred pounds and unto each of my two other Daughters Ann and Mary MASON the Legacy or Sum of Three hundred Pounds Which said Legacies I do hereby give and bequeath accordingly and do direct that the same shall be paid by my said Son Michael MASON his heirs executors administrators or assigns at the expiration of twelve Calender Months next after my decease Also I give and bequeath unto my said Son Michael MASON All and singular my household goods and furniture, plate linen and china brewing vessels and Utensils Stock in trade, horses Cows and other Cattle, Sheep, Pigs, Crops of Corn and Grass, Waggons, Carts, implements of husbandry and all other my personal estate of what nature kind or sort soever the same shall or may consist at the time of my decease (except my ready money, bonds, bills, notes, and other Securities for money book and other debts) to and for his own absolute use benefit and disposal And I do hereby charge subject and make chargeable my said Personal estate hereinbefore bequeathed to my said son Michael MASON (as well as the said real estate so devised to him as aforesaid) and also him my said son Michael MASON his heirs executors administrators and assigns to and with the payment of the said several Legacies hereinbefore bequeath to my other children as aforesaid Also I give and bequeath unto my said son Michael MASON the Legacy or Sum of two hundred pounds to be paid to him by my executors hereinafter named out of the residue of my personal estate hereinafter bequeathed And as to for and concerning all and singular my ready money bonds bills notes and other Securities for money book and other debts and all other my Personal estate and effects not hereinafter by me otherwise disposed of I give and bequeath the same unto my friends Griffith ROBERTS of Higham Ferrers in the said County of Northampton Draper and William MARRIOTT of Rushden aforesaid Blacksmith Upon Trust that they the said Griffith ROBERTS and William MARRIOTT and the survivor of them his executors or administrators do and shall as soon as conveniently may be after my decease collect get in and receive the same.  And do and shall in the first place pay and discharge thereout all my just debts funeral and testamentary expenses and the Legacy of two hundred pounds hereinbefore bequeathed to my said son Michael MASON and after payment and satisfaction thereof upon further trust that they do and shall pay distribute and divide all the remaining monies to arise and be received as aforesaid unto between and amongst my eldest son Stewart MASON my said sons Michael and John MASON and my said daughters Elizabeth SMITH Ann MASON and Mary MASON in equal shares and proportions And my will is and I do hereby declare that the reason I have not bequeathed any thing to my said eldest son Stewart MASON except a share of the residue of my personal estate, is, because he is already sufficiently provided for by me having upon his settling in business given him the sum of one thousand Pounds for his advancement in the world And I do also declare that he now stands indebted to me on his note of hand the Sum of Seven hundred Pounds which with the interest due thereon he will have to pay unto my said executors And I do hereby nominate constitute and appoint the said Griffith ROBERTS and William MARRIOTT executors of this my last will and testament And it is my will and meaning that my said trustees or either of them shall not be liable to answer or make good any loss or losses that shall or may happen to my estate and effects unless the same shall so happen by or through their or either of their wilful neglect or default nor shall either of them my said trustees be answerable or accountable for the other of them but each of them only for his own separate acts deeds receipts and disbursements And I do hereby direct that my said trustees shall and may pay and reimburse themselves and himself, out of my estate and effects all reasonable and necessary costs charges and expenses whatsoever as they may respectively bear pay suffer sustain expend or be put unto in about or concerning the execution of the trusts hereby in them or him reposed And hereby revoking and making void all former and other wills by me at any time or times heretofore made I do declare this present writing to be and contain my only true last will and testament In Witness whereof I the said John MASON the testator have to this my last will and testament contained in three sheets of paper set my hand and Seal (that is to say) my hand to each of the two preceding sheets and my hand and Seal to this third and last Sheet the twelfth day of September in the year of our Lord One thousand eight hundred and twenty one. –

Codicil dated 24 October 1821

Whereas I the above named John MASON have in and by my written last Will and Testament given and bequeathed unto my daughter Elizabeth SMITH widow the Legacy or Sum of Four hundred pounds and have charged the same upon my real estate devised to my son Michael MASON And I have also given and bequeathed unto my said Son Michael MASON the Legacy or Sum of Two hundred pounds And Whereas I have already advanced and paid or secured to be paid unto my said daughter Elizabeth SMITH the sum of Four hundred pounds Now I do by this Codicil which I desire may be added to and taken as part of my last Will and Testament revoke make void the said Legacy or Sum of Four hundred pounds so as aforesaid given and bequeathed to my said daughter Elizabeth SMITH and also the said Legacy or Sum of Two hundred pounds so as aforesaid given and bequeathed to my Said Son Michael MASON And I do hereby ratify and confirm my said Will in all other respects not hereby altered or revoked In Witness whereof I the Said John MASON have to this Codicil set my hand and Seal the twenty fourth day of October in the year of our Lord one thousand eight hundred and Twenty one

        Second Codicil of John MASON, dated 20th Mar 1829

Whereas I John MASON of Rushden in the County of Northampton Yeoman have in and by my last Will and Testament in Writing bearing the date the twelfth day of September in the Year of our Lord One thousand eight hundred and twenty one as to for and Concerning All and singular my Ready Money Bonds Bills Notes and other Securities for Money Book and other Debts and all other my Personal Estate and Effects not thereinbefore by me otherwise disposed of I have given and bequeathed the same unto my Friends Griffith ROBERTS of Higham Ferrers in the said County of Northampton Draper and William MARRIOTT of Rushden aforesaid Blacksmith Upon the Trusts in my Said Will mentioned and Appointed the Said Griffith ROBERTS and William MARRIOTT Executors of my Said Will, Now I do by this Codicil to my said Will revoke the bequest of my Said Personal Estate so given to the Said William MARRIOTT Upon the Trusts in my Said Will mentioned and also the Appointment of his being an Executor to my Said Will, And in lieu thereof I give and bequeath the same Personal Estate so in and by my said Will given and bequeathed to the said Griffith ROBERTS and William MARRIOTT, unto the said Griffith ROBERTS and Richard ATTENBOROUGH of Loughborough in the County of Leicester Maltser Upon the Trusts in my said Will mentioned and declared concerning the same And I do hereby Appoint the said Richard ATTENBOROUGH Executor of my said Will in lieu of the said William MARRIOTT And I do in all other resepcts hereby ratify and confirm my said Will and Codicil thereto Annexed In Witness whereof I the said John MASON have hereunto set my hand and Affixed my Seal this twentieth day of March in the Year of our Lord One thousand eight hundred and twenty nine –

On the twenty fourth day of October 1829 Griffith ROBERTS of Higham Ferrers Draper one of the Executors named in the within will bee then sworn (a form having been received for the other Executor Richard ATTENBOROUGH to Administer) well and faithfully to fulfil the same with the Codicils anexed according to Law, and that the Goods, Chattels, and Credits of the within named Deceased, at the time of his Death, which happened on fifteenth day of April 1829, did not amount in value to the sum of one thousand pounds before me
