Barbara Marriott – will 1841


This is the last will and Testament of me Barbara Marriott of Rushden in the County of Northampton Widow – In the first place I direct my executors hereinafter appointed to pay and discharge all my just debts funeral and Testamentary expenses as soon as conveniently may be after my decease. I Give and bequeath unto my Granddaughter Barbara Willding Linnett my Two Silver Table Spoons, And Pair of Silver Sugar Nippers and Six Silver Tea Spoons, And to my Grandughter Lydia Linnett One Pair of Silver Sugar Nippers and Nine Silver Tea Spoons. I also Give and Bequeath unto my Friends William Achurch and Michael Mason both of Rushden aforesaid Farmers their executors administrators and assigns All other my personal Estate property and effects of what nature or kind soever and wheresoever situate Upon Trust that they the said William Achurch and Michael Mason or the survivor of them his executors or administrators do and shall as soon as conveniently may be after my decease convert the same into Money wither by Public Auction or private Contract as to them or him shall seem most advisable And Upon Further Trust from and out of the Monies arising therefrom to pay satisfy and discharge all my just debts funeral and Testamentary expenses And after payment thereof Upon further Trust to pay and divide the residue of the said Monies equally amongst my three daughters Elizabeth Marriott Spinster, Ann Linnett Widow, and Mary Marriott Spinster as Tenants in Common and not as joint Tenants And I direct that in case any or either of my said daughters shall depart this life before my decease leaving issue such issue respectively shall take their deceased parents share to be paid to him her or them respectively on attaining the age of Twenty one years with Interest in the mean time to be applied towards his her or their respective maintenance and education And I further direct that it shall be lawful for my said Trustees or the survivor of them his executors or administrators to advance any part not exceeding one half of the presumptive share or shares of such issue respectively in or towards his her or their advancement in the world in such manner as they the said Trustees or the survivor of them his executors or administrators shall think fit But the sum or sums so advanced shall be taken as part of the portion of the issue respectively for whose benefit the same is raised and be accounted for accordingly – Provided always and I do hereby declare that the said Trustees or the survivor of them his executors or administrators shall not be answerable for the other of them nor for the acts deeds or defaults of the other of them nor for involuntary losses , nor for money received under receipts in which they shall join only for conformity and that they or he shall and may reimburse themselves and each out of the said trust premises or out of any Monies that may come into their hands by virtue of these presents all costs and expenses to be incurred by them in the execution of the Trusts aforesaid in relation thereunto – And I appoint the said William Achurch and Michael Mason Executors of this my will – And Lastly I hereby revoke and make void all former and other Wills by me at any time heretofore made and do declare this alone to be my true and only last Will and Testament In Witness whereof I the said Barbara Marriott the Testatrix have hereunto set my hand and seal this fourteenth day of November in the Year of our Lord One thousand eight hundred and thirty three.

This is a Codicil to the within written Last Will and Testament of me Barbara Marriott of Rushden in the County of Northampton Widow Whereas since the execution of my said Will my Daughters Elizabeth Marriott and Mary Marriott therein mentioned have departed this life Now I do hereby direct my friends William Achurch and Michael Mason in my said Will named the executors administrators and assigns to share possession of the personal estate (in my said will) bequeathed to them after payment satisfaction and discharge of all my just debts funeral and testamentary expenses Upon Trust to pay the residue of the same monies unto my daughter Ann Linnett Widow and in case my said daughter shall depart this life before my decease leaving any child or children her surviving Upon Trust to pay the same monies to such Children equally, to be divided amongst them if more than one and if but one then to such only one And I further direct that it shall be lawful for my said Trustees or the survivor of them his executors or administrators to advance any part not exceeding one half of the presumptive share or shares of such child or children as aforesaid in or towards his her or their advancement in the world in such manner as they the said Trustees or the survivor of them his executors or administrators shall think fit But the sum or sums so advanced shall be taken as part of the portion of the child or children respectively for whose benefit the same is made and be accounted for accordingly And in all other respects I ratify and confirm my said will In Witness whereof I have herewith set my hand this Fourteenth day of December in the year of our Lord one thousand eight hundred and thirty eight.

On the Eighth day of December 1841 William Achurch and Michael Mason both of Rushden in the county of Northampton Farmers the Executors named in the within written Will were then sworn well and faithfully to fulfil the same and the Codicil thereto according to law And that the goods chattels and credits of the within named Barbara Marriott deceased at the time of her death (which happened on the first day of November 1840) did not amount in value to the sum of £200
