John Margetts 1850

This is the last will and testament of me John Margetts of Rushden in the County of Northampton Mason. I give and bequeathe unto my Sister Sophia Clark the legacy or sum of Ten Pounds Also I give and bequeathe to her all and singular my household goods and furniture plate linen china books wearing apparel and all other my personal estate and effects save and except such parts thereof as shall consist of monies in my possession or which may be due to me at the time of my decease and I direct that the same shall be paid and delivered to her at the expiration of three calendar months next after my decease for her sole and separate use free from the control of her present or any future husband with whom she may intermarry and that her receipt alone notwithstanding her present or any future coverture shall be a sufficient discharge for the same Also I give and bequeathe unto each of my executors hereinafter named the legacy of Five Pounds
Also I give and bequeathe unto Mary Doyle of Rushden aforesaid Singlewoman the legacy or sum of Fifty Pounds and I direct that the same shall be paid to her free from Government or Legacy duty which I will shall be paid by my executors out of the monies which shall come to their hands by virtue of the trusts of this my will Also I give and bequeathe unto John Packwood of Rushden aforesaid Mason the legacy of ten Pounds Also I give and devise unto my Friends John Radburne of Rushden aforesaid Draper and James Sargent Darnell of the same place Butcher and their heirs all my freehold messuages Cottages lands tenements hereditaments and real estates situate and being in Rushden aforesaid or elsewhere and I direct that it shall and may be lawful for them or the survivor of them his heirs and assigns to sell and dispose of the same and also of my copyhold Messuages Cottages lands tenements hereditaments and real estate situate and being in Rushden aforesaid or elsewhere with the appurtenances or any part or parts thereof respectively either together or in parcels and either by public auction or private contract for such price or prices in money as to them or him shall seem reasonable and to convey the same to the Purchaser or respective Purchasers thereof or as he or they shall or may direct or appoint and I further direct that the said John Radburne and James Sargent Darnell and the survivor of them his heirs and assigns shall stand possessed of the monies arising from the sale of my said freehold and copyhold estates and of the rents and profits thereof in the meantime and until sold upon the trusts herein after contained concerning the same Also I give and bequeathe unto the said John Radbourne and James Sargent Darnell their executors and administrators all and singular the monies which may be in my possession at the time of my decease or which may be then due and owing to me and I will and direct that my said Trustees or the Trustees or Trustee for the time being of this my will shall and do pay my debts the legacies by me given and bequeathed and all expenses incidental to the Trusteeship and in the next place divide all and singular the sale monies of my said real estates and all other monies which shall or may come to their or his hands or hand by virtue of this my will into Eight equal parts and pay one eighth part or share thereof unto each of my eight Brothers and Sisters namely the said Sophia Clark and William Margetts Thomas Margetts Elizabeth Margetts Mary Hopkins Lucy Margetts Hannah Bailey and Maria Whittal and I direct that the eighth part or share bequeathed to or in trust for the said Sophia Clark shall be paid into her own proper hands for her sole and separate use free from the control of her present or any future husband and I direct that her receipt alone shall be a sufficient discharge for the same notwithstanding her present or any future coverture I empower the Trustees or Trustee for the time being of this my will to give receipts for all monies and effects to be paid or delivered to them or him by virtue of this my will and I declare that such receipts shall exonerate Purchasers and all other persons taking the same from all liability to see to the application or disposition of the money and effects therein mentioned and I authorize my said Trustees or Trustee for the time being to retain and reimburse themselves and himself all costs charges and expenses incidental to the execution of the trusts herein contained I will and direct that they respectively shall be responsible only for wilful losses neglects or defaults and lastly I nominate and appoint the said John Radburne and James Sargent Darnell Executors of this my will I hereby revoke and make void all former and other wills and codicils and I acknowledge and declare this to be and contain my last will and testament In witness whereof I the said John Margetts the Testator have to this my last will and testament set my hand this nineteenth day of September in the year of our Lord one thousand and Eight hundred and Fifty
