Alice Leete - 1848 Will

This is the last Will and Testament of me Alice LEETE of Rushden in the county of Northampton Widow First I direct all my just debts to be fully paid and satisfied by my executors herewithin named as soon as conveniently may be after my decease I give and bequeath all my personal Estate whatsoever and wheresoever unto my friends William ACHURCH of Rushden aforesaid Farmer and Michael MASON of the same place Farmer their executors administrators and assigns Upon trust for Sale and conversion And upon further trust to invest the monies arising therefrom in their names in or upon the public stocks or funds or other government securities or on real security in the United Kingdom with power to vary the investment from time to time for any other of a like nature And upon further trust to pay apply and appropriate the dividends interest and annual produce of the monies so invested in for or towards the maintenance cloathing and education of my daughter Mary Grace LEETE until she shall arrive at the age of Twenty one years or until her marriage which shall first happen And upon her attaining her said age of Twenty one years or on her marriage (provided the same shall take place with the consent of the trustees or trustee for the time being of my will) Upon trust to pay or transfer all the principal and unapplied dividends interest and annual produce of the said monies unto her my said daughter to and for her absolute use and benefit to whom I do hereby give and bequeath the same accordingly And in case my said daughter shall depart this life under the said age of twenty one years and without being married as aforesaid Then I direct that the trustees or trustee for the time being of my will shall stand possessed of the said principal monies and all the unapplied dividends interest and annual produce thereof Upon trust for the person or persons who shall be my next of kin at the time of the decease of my said daughter Provided always that in case the said dividends interest and annual produce of the said principal monies shall be insufficient to provide for the due maintenance cloathing and education of my said daughter I whereby empower the said trustees or trustee from time to time to pay apply and appropriate any part of the said principal monies as they or he may think proper for the same purpose and I also empower them or him to advance any part of the same principal monies as they or he shall think fit in placing out my said daughter as an apprentice to any trade or business or otherwise for her advancement in the world And I do hereby express my desire that my said daughter shall be placed with my sister Sarah WILLIS now residing at Cringle Fort near Norwich if she and my said trustees or trustee can make a satisfactory arrangement but I do hereby declare that this my desire shall not be [construed] unto a trust but left in the absolute discretion of my said trustees or trustee notwithstanding any rule of law or equity to the contrary Provided also and I declare that if the said trustees or either of them or any trustees or trustee to be appointed under this provision shall die in my life time or after my decease or shall decline or become unwilling to act as trustees or trustee of my will it shall be lawful for the trustees or trustee for the time being whether continuing or declining to act or if none for the executor or administrator of any deceased trustee to appoint any fit person to be a trustee or trustees in the place of any trustee or trustees dying or becoming unwilling or unable to act And I declare that the trustees for the time being of my will shall not be answerable for each others acts or receipts nor for losses happening without theire own respective default and shall be at liberty to retain and allow to each other all expenses incident in the execution of the trusts and powers of my will And I nominate constitute and appoint the said William ACHURCH and Michael MASON Trustees and Executors of this my will and also guardians of my said daughter during her minority And lastly hereby revoking and making void all wills codicils and testamentary dispositions by me at any time heretofore made I declare this to be and contain my only true will and testament In Witness whereof I have hereunto set my hand this 7th day of April in the year of our Lord One thousand Eight hundred and forty seven

On the Twenty fourth day of May 1848 Michael MASON of Rushden in the county of Northampton Farmer and William ACHURCH of Rushden in the said county of Northampton, the Executors Named in the within written will was then sworn well & faithfully to perform & fulfil the same And that the said deceased at the time of her death Which happened on the Twenty second day of June 1847 was not possessed of funds & Chattels & Credits of the value of Two hundred Pounds
