Gearye Thomas 1577

In the name of God Amen the twenty and fyvethe day of July in the year of our Lord one thousand five hundred seventy five and in the seventeenth year of the reign of our Sovereign Lady Queen Elizabeth &c I Thomas Gearye of Rushden in the County of Northampton husbandman being sick in body but of good and perfect remembrance [thanks be] to God his pleasure do ordain and make this my testament containing my last will in manner and form following. First I recommend my soul to Almighty and living God my redeemer and saviour and my body to the Christian burial in the church of Rushden aforesaid. Then I do will give and bequeath all and singular my lands tenements and hereditament situate lying and being in Wilby in the said County of Northampton which I lately purchased to me and my heirs of one John Moulton of Wilby aforesaid in manner and form following that is to say to the said John Moulton for the term of three years after the decease of Clemente Moulton his mother if he happen to overlive her so as he do pay yearly for the same unto John Gearye my eldest son ten shillings at Easter and Michaelmas in the name of a rent and the reversion of all and singular the same lands tenements and hereditaments I do will give and dispose and bequeath to the said John Gearye my son and to his heirs and assigns for ever. Item my will and full intent is that my son Raphael Gearye shall have that moiety of the copyhold farm or tenement which I now dwell in and lately bought of my brother William Lambe of Caldecott in the said County of Northampton with the moiety of all the lands meadow and pasture to the same farm or tenement belonging and that the same moiety shall be conveyed and assured according to the Custom of the Manor of Rushden aforesaid to the said Raphael and to his heirs and assigns for ever And if he the same William Lambe shall refuse after my decease to convey and assure the said moiety of the said farm or tenement and other the premises unto my said son Raphael as is aforesaid and by law may not be thereunto compelled and inforced then mine intent and meaning is that the said Raphael shall have all such money as I have already paid for the same unto the said William Lambe that is to say thirty five pounds. Item I give dispose will and bequeath unto my son William Gearye all mine estate interest and term of years yet to come and unexpired in and to one farm situate and being in Wymington in the said County of Bedford late Ewyn Johans of Wymington aforesaid together with the indentures of lease of the same farm Item my will and meaning is that my son Thomas Gearye shall have my copyhold farm with all the land meadows and pasture to the same belonging in Rushden aforesaid which I lately purchased of one Nicholas Adson and that the same shall be by me surrendered according to the Custom of the said Manor to the use of the same Thomas and of his heirs and assigns for ever and I do will give and bequeath one freehold close which hath been usually occupied with the said copyhold unto the said Thomas my son and to his heirs for ever. Item I will that my son Lawrence Gearye shall have my copyhold tenement with all the land meadow and pasture to the same belonging in Rushden aforesaid which I lately purchased of one John Griffith alias Peryn now deceased And mine intent and meaning is to surrender the same according to the custom aforesaid to the use of the same Lawrence and of his heirs and assigns for ever. Item I give and bequeath to Margery my wife a yearly rent or sum of money amounting yearly to three pounds which is payable and due unto me by Robert Margettes of Upwoodde in the County of Huntingdon yeoman for so many years as one lease for term of years of one farm against Mr Pembertons house in Rushden with the land meadow and pasture thereto belonging made by the said Robert Margettes unto one John Darling in Rushden aforesaid shall might or ought to endure saving the last years rent or payment thereof which I do give and remit to the said Robert Margettes. Item I do give and bequeath unto the said Margery my wife and to my said son John five horses jointly between them. Item I give and bequeath to Raphael William and Thomas my three sons three colts of the age of three years that is to say to every of them one colt. Item I give and bequeath unto Margery my said wife eight milk kine Item I give and bequeath to my four sons Raphael William Thomas and Lawrence four milk kine that is to say to every one of them a cow. Item I give and bequeath to John my son a yolk of oxen and two heifers. Item I give and bequeath to my three sons Raphael William and Thomas each of them one bullock. Item I give and bequeath to Lawrence my son two bullocks. Item I give and bequeath to Margery my said wife and to my said son John one hundred sheep to be equally divided between them. Item I give and bequeath to my four sons Raphael William Thomas and Lawrence one hundred sheep that is to say to each of them thirty sheep. Item I give and bequeath to Elizabeth Gearye my mother and to my brother John Gearye twelve quarters of malt between them whereof six quarters to be answered and delivered this year and other six quarters the next year following after harvest. Item I will that four quarters of malt be sold after the rate of the market and that Thomas Margettes the horseco’ser shall have the use of the money that shall arise by the sale of the same four quarters for the space of three years and at the end of the same three years to repay the same again to the said Margery my wife. Item I give and bequeath to Thomas Carter of Higham Ferrers one acre of barley and half an acre of peas now growing within the fields of Rushden aforesaid. Item I give and bequeath to my godson Robert Clare half a quarter of malt. Item I give and bequeath to my godson Peter Lambe half a quarter of seed barley. Item I give and bequeath to Hugh Grey of Wymington half a quarter of malt. Item my will and meaning is that my crop now on the ground shall be continued from year to year in the joint occupation of Margery my wife and of my son John until all the rest of my children shall accomplish the age of eighteen years at the which age I will that every of my sons shall have five quarters of barley apiece. Item I give to my son John three quarter of malt. Item I give unto my son Raphael one quarter of malt. Item I bequeath to my four sons John Raphael William and Thomas each of them a cart. Item I give to the church of Rushden six shillings eight pence in consideration of the burial of my body there. Item I bequeath to the poor people of Rushden and Wymington twelve strikes of malt to be disposed at the discretion of mine Executors. Item I give to the maintenance of the bells of Rushden twenty pence. Item I bequeath to the bells of Wymington twenty pence. Item all my household stuff with all the rest of my goods movable unbequeathed after my debts paid legacies performed and my funeral expenses discharged I give and bequeath to Margery my wife. Item I ordain and make for the Executing of this my last will and testament Margery my said wife and my said son John mine Executors and William Margettes my uncle my supervisor to whom I give ten shillings in witness whereof to this my will and testament I have put my hand these bearing witness
