John Fox - Will 1664

Will of John FOX snr, dated 18th Nov 1663

In the name of God Amen the eighteenth daie of Novembre Ano dni 1663 and in the fifteenth Yeare of the raigne of our Souveraiyne Lord Charles the Second by the grace of god of England Scotland Fraunce and Ireland King Defender of the Faith &c I John FOXE the elder of Rushden in the County of North’ton yeoman, being aged and groweing somwhat infirm of body but of and in perfect minde and memory praysed bee allmighty god for the same Calling to mind the frailty and instability of this Mortall life, doe make & ordain this my last will and Testament in manner and forme followeing that is to say First I doe Commend my Soule unto allmighty god the Father my maker and to Jesus Christ his onely sonne & my Saviour and Redeemer beleeving assuredly by the merritts and passion of Jesus Christ to have and enjoy everlasting life and salvation And my body to bee buried in Christian buriell at the discretion of my Executor and freinds Item I doe give and bequeath unto my grandchild Mary FOXE the daughter of my sonne William FOXE a legacie or sume of ten poundes of lawfull English money Item I doe give and bequeath unto my grandchild Susan FOXE the daughter of my sonne Thomas FOXE the like legacie or sume of ten poundes Item I doe give and bequeath unto Francis Mary and Elizabeth GAWTHARNE the sonne and daughters of my sonne in lawe Richard GAWTHARNE of Grendon a legacie or sume of thirty poundes equally amongst them Allso the sayd legacie shall bee payed to my sayd grandchildren at theire severall ages of one and twenty Yeares Item I doe give and bequeath unto my grandchild Mary MAY the daughter of my daughter Mary MAY of Rushden aforesaid widdowe that twenty poundes Sterling which is in her mothers hand nowe oweing to me my will is that her mother shall keep it in her hande for five yeare after my decease and then to bee payed and the sayd daughter Mary MAY to receive the same at her age of one & twenty yeare Item I doe give and bequeath unto my grandchild John FOXE the elder sonne of my sonne John FOXE a legacie or sume of ten Poundes  to bee payed to him at his age of one & twenty yeares Item I doe give and bequeath unto William FOXE my grandchild one other of the sonnes of the sayd John FOXE my sonne a legacie or sume of forty Poundes of like money which is in the hands of my sonne William FOXE And my will is  that my Executor shall putt forth and employ the same legacie to the best use and benefitt at interest for the use of my sayd grandchild untill his age of twoe and twenty yeares, And the same and all the interest and benifitt therof arriseing & to bee made shall bee paied unto my sayd grandchild William FOXE at such tyme as hee shall attaine & come to his sayd full age of Twoe and twenty yeares Item I doe give and bequeath unto my grandchild Samuell FOXE one other sonne of my sayd sonne John FOXE a legacie or sume of ten poundes Sterling to bee payd at his age of one and twenty yeares Item I doe give and bequeath unto my daughter Elienar GAWTHARNE the nowe wife of my sayd sonne in lawe Richard GAWTHARNE of Grendon All those my pieces and parcells of land & Meadow ground in Grendon aforesayd cont[aining] by Estimation Nyne acres which I did lately purchase of my sayd sonne in lawe Richard GAWTHARNE to bee and remaine unto her my sayd daughter GAWTHARNE for & during the tearme of her naturall life And after her decease I doe will and bequeath the sayd land & Meadow grounds unto Thomas GAWTHARNE my grandchild the youngest sonne nowe living of my sayd sonne in lawe Richard GAWTHARNE and to the Heires of his body lawfully to bee begotten And for want of such Heires the same shall bee & remaine unto my grandchild Samuell FOXE the sonne of my sonne John FOXE of Rushden to his Heires and Assignes forever Provided allways and uppon this Conditon that hee my sayd grandchild Thomas GAWTHARNE & the heires of his body & Samuell FFOXE and his heires Assignes or some of them doe and shall truly content & paye out of the Same Land & Meadow ground the full sume of thirty poundes Sterling unto my sayd two grandchildren Mary GAWTHARNE & Elizabeth GAWTHARNE sisters of the sayd Thomas GAWTHARNE my grandchild and to the Heires of theire bodies equally betwixt them within twoe yeares next after the death of theire sayd mother my daughter Elionar GAWTHARNE If the sayd two daughters Mary GAWTHARNE Elizabeth GAWTHARNE shall bee then liveing, if in case either of them twoe my sayd grandchildren shall bee deade before the sayd day of payment & doe leave yssue of theire body liveing after each of theire decease then my will is that the Heires of such my sayd grandchildren deceased shall have & enjoy that part of her mothers portion in the sayd legacie of Thirty poundes which should have been payed to her mother in case shee had lived to receive it her[self] Item I doe give and bequeath unto my said grandchild Anne GAWTHARNE to & heires my forever my peeces of Meadow ground in Grendon aforeSayd cont[aining] by Estimaton three acres which I lately purchased of Thomas Allen of WOLLASTON Item I doe give and bequeath more unto my sayd grandchild Anne GAWTHARNE a legacie or sume of ten Poundes of like money and my bedsted & bedding that which belongeth to yt in Grendon Item I doe give and bequeath unto my two sonnes Thomas FOXE & William FOXE five shillinges a peece to each of them to whom I have formerly given portions Item all the residue of my goods cattalls and chattells unbequeathed my debts Being paied my Legacies performed & my funerall Discharged I doe give and bequeath the same unto my [sayd] sonne John FOXE whom I doe make the Sole Executor of this my last will & testamt In Wittnes whereof I have to this my last will & testamt Sett my hand and Seale Dated the Day & Yeare first above written.
