Thomas Denton - 1835 Will

                   Will of Thomas DENTON, dated 21st of May 1830

This is the Last Will and Testament of me Thomas DENTON of Rushden in the County of Northampton Shopkeeper made when of sound mind memory and understanding I give and Devise All those my four Copyhold or Bondhold Messuages Outbuildings Gardens and Appurtenances thereto belonging situate and being in the Church Lane in Rushden aforesaid now or late in the several tenures or Occupations of William LINNIT my Son William DENTON George MARRIOTT and William WIMPRESS, Unto Thomas SANDERSON of Wellingborough in the said County Grocer and my Son Francis DENTON of Higham Ferrers in the said County Yeoman To Hold the same and every part thereof with the Appurtenances unto and To the Use of the said Thomas SANDERSON and Francis DENTON their heirs and Assigns for ever Upon Trust to sell the same by public Sale or Private Contract for the most money and best price which can be reasonably Obtained for the same and Surrender the same to the Purchaser or Purchasers thereof and to pay and apply the money to arise from the Sale thereof after deducting the expences attending such Sale and making out the Title thereto in manner following (that is to say) the Sum of fifteen pounds to my Son Baker DENTON and the Sum of fifteen Pounds to my Son William DENTON and the Sum of Thirty Pounds to my Son Thomas DENTON and the residue thereof together with the rents of the said Messuages and premises until the same are sold and the Purchase completed unto my Son Joseph DENTON to whom I hereby give and bequeath the same accordingly I give Devise unto my Son Daniel DENTON of Kings Cliffe in the said County of Northampton Shoemanufacturer All those my two Copyhold Messuages or Tenements with the Gardens and Appurtenances thereto belonging situate at Cottingham in the said County of Northampton now or lately Occupied as four Tenements and let by me to the churchwardens and Overseers of Cottingham To Hold the same and every part thereof with the Appurtenances unto and to the use of my said Son Daniel DENTON his heirs and Assigns for ever Subject and Chargeable with and I do hereby make the same Premises liable to the Payment thereout by my said Son Daniel DENTON the Sums of Money following, that is to say, to my Daughter Mary the Wife of Daniel POOLE of Rushden the Sum of Ten Pounds to my Daughter Rebecca the Wife of John DRAPER the like Sum of Ten Pounds and to my Son in Law John LOVELL of Wilby Shoemaker the Sum of Thirty Pounds to be paid to them within twelve Calendar Months from the time of my decease And for promoting and facilitating the Sale or Sales of the said Messuages and Premises so by me devised to the said Thomas SANDERSON and Francis DENTON In Trust for Sale as aforesaid I do hereby declare that the Receipt or Receipts of my said Trustees or the Survivor of them or the heirs of such Survivor shall be a good and Sufficient discharge and discharges to the Purchaser or Purchasers thereof and who after having Received such Receipt or Receipts shall not be Obliged to see to the Application of such Purchase Money or any part thereof or be in any wise Answerable or Accountable for the loss misapplication or nonapplication thereof or any part thereof I Give and Devise to my said Son Francis DENTON All that my Copyhold or Bondhold Messuage or Tenement with the Outbuildings Garden and Appurtenances thereunto belonging situate and being at Rushden aforesaid now in my Occupation To Hold the same with the Appurtenances unto my said Son Francis DENTON his heirs and Assigns for ever I Give and Bequeath All my Household Furniture Wearing Apparel Book debts Ready Money Securities for Money and all other my personal Estate and Effects whatsoever and wheresoever and of what nature or Kind soever unto my said Son Francis DENTON his executors and administrators Subject to the payment of my just debts Funeral and Testamentary expences And I do Appoint the said Thomas SANDERSON and my said Son Francis DENTON Executors of this my Will, who shall have Power to reimburse themselves all Costs and Charges they may be put to in executing the Trusts of this my Will and each of them shall be Answerable for his own Acts deeds Receipts and Payments only ~ In Witness whereof I have hereunto set my hand and Affixed my Seal this twenty first day of May in the Year of Our Lord One thousand eight hundred and thirty
