John Darnell - will 1820

This is the last Will and Testament of me John Darnell of Rushden in the County of Northampton Yeoman – Whereby I dispose of my Estates both real and personal in the manner following that is to say First I direct that all my just Debts Funeral and Testamentary expenses be fully paid satisfied and discharged by my Executor herinafter named All that my Messuage or Tenament situate in Rushden aforesaid and now in the Occupation of William Elliott Also All that my Messuage or Tenement now in the occupation of John Baker Also All that my Messuage or Tenement and homestead in which I now dwell with the Orchard thereto adjoining and close of pasture land adjoining the said Orchard Situate in Rushden aforesaid being Copyhold and Surrendered to the Use of this my Will All which said Messuages Tenements Lands Hereditaments and premises with the Appurtenances I give and Devise unto my Wife Elizabeth Darnell and Assigns for and during all the Term of her Natural Life she keeping the said Messuages or Tenements in Tenantable Repair during all the said Term and from and after her Decease I Give and Devise All that my said Messuage or Tenement now in the Occupation of the said William Elliott Unto my eldest son John Darnell To Hold All the said Messuage or Tenement with the Appurtenances unto my said son John Darnell his Heirs and Assigns for ever and from and after the Decease of my said Wife Elizabeth I Give and Devise All that my said Messuage or Tenement now in the Occupation of the said John Baker Also All that my said Messuage or Tenement and Homestead in which I now dwell Together with the said Orchard thereto adjoining and the said Close of Pasture Land adjoining the said Orchard Unto my youngest son Henry Darnell To Hold All the said Messuages Tenements Homestead Orchard Close of pasture Land with their and every of their Appurtenances unto my said son Henry Darnell his Heirs and Assigns for ever nevertheless subject to the condition proviso and limitation hereinafter mentioned and declared – that is to say – that he do and shall pay to my son William Darnell the sum of ten Pounds to my son Daniel Darnell the sum of ten Pounds and to my Daughter Hannah Parselow the sum of ten Pounds And I do hereby expressly Charge make chargeable and liable All my said real Estate so given and Devised unto my said son Henry Darnell to and with the payment thereof and I Give and Bequeath the said sum of ten Pounds a piece unto my said sons William Darnell Daniel Darnell and my said Daughter Hannah Parselow to be paid to them six calendar months after the decease of my said wife Elizabeth And I do hereby direct my said son Henry Darnell that he do and shall pay to my said wife Elizabeth Lawfull Interest for the sum of thirty Pounds Given to my said two sons and daughter as aforesaid Also the Lawfull Interest for all Monies or security for all monies I may be possessed of at the time of my Decease by five even and Equall payments every year for and During all the Term of her Natural Life the first payment to begin and be made six Calendar Months after my Decease and the same to be made afterwards every six Months during all the said Term I Give and Bequeath the Use of all my Household Goods and Linen Unto my said Wife Elizabeth for and during the Term of her Natural Life and from and after her Decease I Give and Bequeath the same unto my said youngest son Henry Darnell All the rest residue and remainder of my personal Estate and Effects whatsoever and wheresoever of what and nature and kind soever the same may be or Consist at the time of my Decease I Give and Bequeath the same unto my said son Henry Darnell And I do hereby Nominate make and Appoint my said youngest son Henry Darnell full and Sole Executor of and to this my last Will and Testament – and Lastly I do declare this writing that is Contained on two sheets of paper and none other to be and Contain my Last Will and Testament - In Witness whereof I the said John Darnell The Testator have to this my last Will and Testament set my hand to the first Sheet and my hand and Seal to the second and Last Sheet thereof the Eleventh Day of May in the year of our Lord One thousand eight hundred and Nine.

Who died on the eighteenth Day of January 1820
maketh oath of Faith that he has
made diligent Search and due Enquiry after and in respect of the Personal
Estate and Effects of the said Deceased, in order to ascertain the full Amount
And Value thereof; and that to the best of his Knowledge, Information, and
Belief; the Whole of the Goods, Chattels, and Credits of which the said deceased
Died possessed, within the Diocese of Peterborough (exclusive of what the
Deceased may have been possessed of, or intitled to as a Trustee for any other
Person or Persons, and not beneficially, but including the Leasehold Estates
for Years of the Deceased, whether absolute or determinable on Lives, and
without deducting any Thing on Account of the Debts due and owing from the
Deceased) are under the Value of Thirty Pounds.
