William Corby - will 1848

This is the last Will and Testament of me William Corby of Rushden in the County of Northampton Lace dealer - I give and bequeath unto my dear wife Susannah Corby all the monies of which I may be possessed or to which I may be entitled at the time of my decease to and for her own absolute use benefit and disposal Also I give and bequeath unto my said wife and her assigns for and during her natural life all and singular my household goods Furniture Plate Linen China and Books and all other my personal estate and effects not hereinafter by me otherwise given and disposed of ... ... ... my wearing apparel To hold to her and her Assigns for ever during the term of her natural life and from and after her decease I give and bequeath one moiety or equal half part of the same unto my daughter Elizabeth the wife of Saby Knight of Rushden aforesaid Carpenter and the other moiety thereof unto and equally between and amongst my two other daughters Karenhappuch Baker and Elizabeth Baker their Executors Administrators and Assigns share and share alike as Tenants in common Also I give and bequeath all and every the wearing apparel of which I shall die possessed unto and equally between and amongst my two sons Joseph Corby and John Corby their Executors Administrators and Assigns share and share alike Also I give and devise unto my said dear wife and her Assigns for and during the term of her natural life all and every my freehold copyhold and leasehold Messuages Cottages Lands Tenements hereditaments and real estate whatsoever situate and standing and being in Rushden aforesaid or elsewhere with the rights members and appurtenances thereto belonging To hold to her my said wife and her Assigns for and during the term of her natural life and from and after her decease I give and devise unto my said Son Joseph Corby and his heirs all that Messuage Cottage Tenement in which I now dwell together with the Brewhouse yard and appurtenances thereto adjoining and belonging subject nevertheless to a right of footway over the same yard for the owners and occupiers for the time being of the respective hereditaments and premises by me hereinafter given and devised unto the said John Corby and Saby Knight and also all that plot piece or parcel of land or ground lying near to the said Messuage Cottage or Tenement and now occupied therewith and which said plot piece or parcel of land or ground contains by estimation three perches and a half or thereabouts be the same more or less and is bounded on or towards the North by two gardens hereinafter by me given and devised to the said Saby Knight and John Corby respectively on or towards the West by hereditaments belonging to or occupied by Mr Michael Mason and on or towards the South and East by premises belonging to or occupied by James Clark and Baker Denton respectively together with a right of footway to and from the said plot piece or parcel of land or ground over and along the East and West sides or ends of the plot or parcel of land adjoining thereunto on the North End hereinafter by me given and devised to my said son John Corby is the same road is now set out and used together also with full right and liberty for the said Joseph Corby his heirs or Assigns and the owners or occupiers for the time being of the said hereditaments and premises hereby devised to the said Joseph Corby and his heirs to use the well on the premises hereinafter devised to my son John Corby To hold the same unto my said son Joseph Corby his heirs and Assigns for ever Also i give and devise unto my son John Corby and his heirs all that Copyhold Messuage Cottage or Tenement situate standing and being in Rushden aforesaid and now in his own occupation together with the yard garden and appurtenances thereunto adjoining and belonging and which said Garden exclusive of the way or path over the same leading to the Premises by me hereinafter devised to the said Saby Knight and which said way or path and the soil and freehold there I give and devise unto the said John Corby and his heirs contains by admeasurement three perches or thereabouts be the same more or less and is bounded on or towards the West by land hereinafter by me given and devised to the said Saby Knight on or towards the North by premises in the occupation of Samuel Summerly or towards the South by the land or garden hereinbefore by me given and devised to the said Joseph Corby and by premises belonging to or occupied by the said James Clark and on or towards the East by the yard hereinbefore devised to the said Joseph Corby To hold the same unto the said John Corby his heirs and Assigns for ever subject nevertheless to the rights and privileges hereinbefore given to the said Joseph Corby and to the rights and privileges hereinbefore given to the said Saby Knight and subject also to and charged with the payment of the legacies or sums of Ten Pounds apiece to each of my said two Granddaughters Kerenhappuch Baker and Elizabeth Baker which I hereby give and bequeath to them accordingly and I will the same to be paid to them respectively at the ......... of twelve calendar months next after the decease of my said wife but in case either of them my said two Granddaughters shall depart this life in the life of my said wife I will and direct that the legacy of such of them so dying shall be paid and payable to the survivor of them in case such survivor shall outlive my said wife but not otherwise Also I give and devise unto the said Saby Knight and his heirs all that Copyhold Messuage Cottage or Tenement situate and being in Rushden aforesaid and now in his own occupation together with the garden and appurtenances thereto adjoining and belonging and which said Garden contains by admeasurement two perches and a half or thereabouts and the said premises are bounded on or towards the North by premises in the occupation of the said Samuel Summerly and on or towards the West by premises in the occupation of the said Michael Mason on or towards the East by the hereditaments and premises hereunto before devised to the said John Corby and or or towards the South by the land or garden hereinbefore devised to the said Joseph Corby together with full right and liberty for the said Saby Knight his heirs and Assigns and the owners and occupiers for the time being of the said Premises herby devised to the said Saby Knight to use the present ... said road or way leading therefrom to the Turnpike Road and also to use and obtain water from the said well on the premises hereinbefore devised to the said John Corby and I will and direct that the said well shall from time to time and at all times hereafter be repaired and kept in repair by and at the joint and equal expense of the owners or occupiers for the time being of the ... ... ... and premises hereby given and devised to the said Joseph Corby John Corby and Saby Knight respectively and lastly I do hereby nominate constitute and appoint Michael Mason of Rushden aforesaid Gentleman and William Baker of the same place Gentleman Executors in trust of this my Will and I do hereby revoke and make void all former and other wills by me at any time herebefore made and do publish and declare this to be and contain my last Will and Testament In witness whereof I have to this my last Will and Testament contained on three sheets of paper set my hand and Seal towit to the two first sheets thereof of my hand only and to this third and last sheet my hand and seal the Twenty seaventh day of July one thousand eight hundred and thirty six.
