Elizabeth Colson 1841

This is the last will and testament of me Elizabeth Colson of Rushden in the county of Northampton spinster I give and bequeath unto my friends John Radburne of Rushden aforesaid draper and John Austin of Podington in the county of Bedford baker their Executors Administrators and assigns all and singular my monies and securities for money debts chattels and personal estate except such part and parts thereof as are otherwise by me herein after disposed of upon trust that they or the trustees or trustee for the time being of this my will do and shall with all convenient speed after my decease collect in and receive all money due to me and invest it in his names or name in or upon government or real securities and do and shall (but without prejudice to the proviso herein after contained) pay the interest dividends and annual produce thereof unto my sister Ann Colson and any part of the principle they the trusts may think necessary during her natural life and from and after the decease of my said sister Ann Colson to divide the Principle of the said Trust monies or so much of the same as may remain unappropriated pursuant to the proviso herein after contained and any unapplied interest thereof that may remain into eleven equal parts or shares thereof to pay one eleventh part or share and equally unto the children of my nephew John Colson son of my brother William Colson one other eleventh part or share thereof and equally between and amongst all and every the children of Elizabeth Colson daughter of my said brother William Colson one other eleventh part or share thereof unto my niece Rebecca Mattock one other eleventh part or share thereof to John Burge son of William Burge one other eleventh part or share to William Burge son of the aforesaid William Burge one other eleventh part or share to Elizabeth Bays daughter of William Burge aforesaid one other eleventh part or share to Mary York daughter of the aforesaid William Burge one other eleventh part or share to my nephew John Nobles one other eleventh part or share to my nephew William Nobles one other eleventh part to be equally divided between the children of my niece Elizabeth Eaton one other eleventh part or share thereof to Elizabeth Burge daughter of my nephew William Burge and in case any of the aforesaid parties shall die before the said trust monies shall become payable then I will and direct that the share or shares of him her or them so dying off and in the said trust monies shall be paid to and divided between his her or their child or children respectively provided always and I do hereby declare that it shall and may be lawful for the said trustees or trustee to pay and appropriate so much and such part or parts of the principle of the said trust monies for and towards the support of my said sister Ann Colson as the trustees may think expedient also I give and bequeath unto the said Elizabeth Bays the bed bedstead and furniture thereof drawers chairs and glass belonging to the front room of the house where I dwell also the tea table in the parlour thereof also I give and bequeath unto the said Mary York a folding table clock four old chairs one box and one chest of drawers of her own selecting Also I give and bequeath unto the aforesaid Elizabeth Burge my bed in which I sleep the bedstead and bedding three trunks one box two small tea tables and chest of drawers in the parlour also I give and bequeath unto my said sister Ann Colson during her natural life the use of all the beds bedsteads chairs tables and other furniture not by me disposed of and after her decease I give the said furniture ---------- all and every the said parties in whose favour I have here before directed the said trust monies to be divided provided always and I further declare that the said trustees shall be charged and chargeable only for such trust monies as they shall actually receive by virtue of the trusts hereof nor for involuntary losses and lastly I do appoint a said John Radburne and John Austin executors of this my will and hereby revoking former wills by me at any time heretofore made I do publish and declare this to be my last will and testament in witness whereof I have hereunto set my hand and seal this twelvth day of march in the year of our lord one thousand eight hundred and thirty eight
