William Clarke - will 1856

This is the last will and testament of me William Clarke of Rushden in the County of Northampton Carpenter I appoint my Friends Morris Whiting of Rushden aforesaid Victualler and John Linnett of the same place Farmer Executors and Trustees of this my will I bequeath to the said Morris Whiting and John Linnett all my personal estate upon trust to sell and convert into money such parts thereof as shall not consist of money and to stand possessed thereof and of such part of my personal estate as shall consist of money upon the trusts hereinafter declared concerning the same I devise unto and to the use of the said Morris Whiting and John Linnett and their heirs all my real estates To hold the same with their appertenances unto the said Morris Whiting and John Linnett and their heirs upon trust to sell and dispose of the same as soon as conveniently may be after my decease either together or in parcels and by public auction or private contract at their discretion and upon further trust with and out of the Monies to be produced from or by my said real and personal Estates and the rents and profits of my real estates until sold to pay and discharge my debts funeral and testamentary expenses and the expenses incidental to the execution of the trusts hereof and in the next place to pay to my Son Joseph Clarke the legacy or sum of Forty Pounds which I give and bequeath to him accordingly and then to pay and divide the surplus monies arising from my said real and personal estates unto and equally between and amongst my four children namely James Clarke Rebecca Sargeant the said Joseph Clarke and Charlotte Belcher. I Empower my Trustees to give receipts for all monies and effects to be paid or delivered to them by virtue of this my will and declare that such receipts shall exonerate the purchasers or other Persons taking the same from all liability to due to the application or disposition of the money or effects therein mentioned and from all responsibility in the event of any misapplication of the same and I exempt every Trustee of this my Will from all liability arising without his own willful default and authorize him to retain to and allow his Cotrustee all expenses incidental to the Trusteeship I revoke all former Wills In witness whereof I the said William Clarke have hereunto set my hand this Fourteenth day of March in the year of our Lord one thousand eight hundred and fifty six

In the Archdeaconry Court of Northampton

On the Seventh day of July 1856 Morris Whiting of Rushden in the County of Northampton Victualler and John Linnett of the same place Farmer the executors named in the within will were there sworn well and faithfully to fulfil the same according to Law and that the Goods Chattels and Credits of the within named Deceased at the time of his death which happened on the 29th day of March 1856 do not amount in balance to the excess of Fifty Pounds
