Williams v Bignell's Ltd 1948

Rushden Echo & Argus, 28th May 1948, transcribed by Kay Collins

Action on Factory Presses - Motion Against Shoe Firm
The motion by Mr. M. A. Williams for an injunction to restrain Bignell’s Ltd., of Station Road, Rushden, from committing an alleged nuisance to plaintiff by noise and vibration was ... ... ... the Chancery Division

When the matter came before Mr. Justice Romer on May 13th Mr. W. M. Hunt, for Bignells Ltd., said they carried on a boot and shoe factory, and there was only a passage between it and the plaintiff's house.

Mr Williams was complaining of noise which came from presses stamping out leather. The four presses were against a wall to plaintiff's house.

The defendants offered to move the presses to another part of the factory, and the application was adjourned until to-day.

Mr. B. Tatham, for Mr. Williams, now stated that there was a complete conflict of evidence in the case, and he asked His Lordship to stand the motion over until the trial of the action,

Mr. Justice Roxburgh made an order accordingly, and gave directions for a speedy trial.
