William Day – will 1771

This is the Last Will and
Testament of me William Day of Wimington in the
County of Bedford Husbandman First I give and bequeath
the Sum of three hundred pounds of lawful Money of great
Britain unto George Spencer of Higham Ferras in the

County of Northampton Husbandman and William Saunders
of the same place Currier and to the Survivor of them and the
Executors or Administrators of such Survivor In Trust to place and
and put out the same at Interest upon Land Security or
Securities as soon as conveniently then can after my decease the
Interest and produce whereof ~ my Will and Mind is [it] shall be
paid and applied in the maintenance Education and Support
of my daughters Elizabeth and Mary Day untill they attain
to their respective ages of one and twenty Years at which
age my Will and mind is that the said Sum of three
hundred pounds shall be paid to and equally divided between
my said daughters Elizabeth and Mary Day Share and
Share alike and if it shall happen that either of my said
daughters shall shall die before she attains to such Age
as aforesaid Then and in such Case I give and bequeath
the said Sum of three hundred pounds to the survivor of them
I give and devise my Messuage or Tenement with the Appurt[enance]s and
and one Land of arrable Land or lay ground thereto belonging now
in the Tenure of John Glover Butcher situate and being within the
Parish and Precincts of Irthlingborow in the County of Northampton
unto my daughter Ann Day her Heirs and Assigns for ever But
if it shall happen that my said daughter Ann Day shall depart
this Life before she arrives to the Age of one and twenty Years
and without lawful Issue of her Body Then and in such Case
I give and devise the said Messuage or Tenement and the said
one Land of arrable Land or ley Ground with their appurtenances
unto my said daughters Elizabeth Day and Mary Day and their
Heirs and Assigns for ever I give and bequeath all the rest
and Residue of my Moneys Goods Chattles and Personal Estate
whatsoever after the payment of my just Debts Funeral Expences and
the said Sum of three hundred Pounds unto my said Trustees as
aforesaid unto my dear Wife Mary Day and do nominate and
appoint her to be the sole Executrix of this my last Will and
Testament In Witness whereof I have hereunto set my Hand and
Seal the twenty sixth day of June in the Year of our Lord One
thousand seven hundred and seventy one William Day Signed
Sealed published and declared by the said William Day as and for
his last Will and Testament in the presence of us who in his
Presence and in the Presence of each other have set our Names as
Witnesses thereto Tho Halles Frances Livesey Charles Livesey


This Will was proved at London the twenty
seventh day of June in the Year of our Lord one thousand seven
hundred and seventy two before the right Worshipful George Day
Doctor of Laws and Master Keeper or Commissary of the Prerogative
Court of canterbury lawfully constituted by the Oath of Mary Day
Widow and Relict of the deceased and sole Executrix named in the
Will to whom Administration was granted of all and singular the goods
Chattles and Credits of the said deceased She having been first sworn by Commission
duly to Administer
