James Smith - will 1775

In the Name of God Amen. I James Smith of the Parish of Chelveston cum Caldecot in the County of Northampton Cottager being sound in mind and memory for which I thank my God calling to mind the mortality of my Body and knowing that it is appointed unto all men once to die, do make and ordain this my last Will and Testament in manner and form following; that is to say; First I constitute make and ordain my Son in Law William Peacock my sole Executor of this my last Will and Testament Also I give to my three grandchildren James, …. and Mary Smith, Son and Daughters of my Son James Smith deceas'd to be equally divided between them the remainder the Sum of Twenty Pounds after the Sum of the sixth part of three shillings provided from the day of the date of this my Will unto the day of my Decease, be deducted; and I give to my two Grandaughters, Mary and Rebecca Wilson, daughters of my Daughter Elizabeth Wilson deceas'd to be equally divided between them the remainder of the sum of Two Pounds after the deduction before mentioned; and my Will is that if any of these my grandchildren above named should Die before their Legacies become due that the survivor shall have their Brother or Sisters part; Also I give to my Son Thomas Smith the remainder of the sum of Twenty Pounds after the deduction in the Legacies before mentioned, Also unto my Son Robert Smith the remainder of the sum of Twenty Pounds after the deduction in the Legacies before mentioned, Also I give to my Daughter Alice Teat the remainder of the sum of Twenty Pounds after the deduction in the Legacies before mentioned. And [my will] is that all the Legacies before mentioned shall be paid by my Executor before named ….. Months after my Decease; Also I give to my said Son Robert Smith my best Coat and Wa..... and my best Hat, and my best Breeches, and my best Shoes, and four shirts; And ….... I give my said Son in Law William Peacock my said Executor All my Estate both Real and Personal; that is to say; all my Crop of Grain either in the Fields or at home, with all …...... Tilth, and all my Stock of Cattle, and all my Implements of Husbandry and all my Furniture together with all that is or Lawfully may be called mine at my Decease and not before in this Will given away; In Witness whereof I have hereunto set my hand this Twentieth day of August in the year of our Lord One Thousand Seven Hundred and Seventy

April 9th 1776 William Peacock the within named Executor appeared and made oath for the due execution and performance of the within written Will, that the Effects were in value above forty Pounds, that he will exhibit a true and perfect Inventory of all the Goods and Chattels belonging to the deceased within six months from this Date into the Registrars Court at Northampton, and make a just and true Account of his said Administration when thereunto lawfully called before me
