James Sawyer - 1703 will extract

This extract from Mr James Sawyer's will was written into the parish register for Raunds.


A copy of that change of Mr James Sawyers will which Concerns Raunds and Chelston or Chelveson as it was attested by the prerogative office at Drs Commons: prob: 30 April 1703

Also I doe hereby give devise and bequeath all and every my messuages cottages closes arrable lands medow grounds leys pasture grounds tenements and Hereditaments with their and every of their appurtenances situate lying and being in the towne parish hamlet fields medows bounds precints and territories of Chelston aforesaid and Denford (but not in Caldicot) in ye said County of Northampton both freehold and Copyhold being surrendered to ye use of my will as well morgages as others together with the moneys due thereupon unto my brother John Sawyer of London Gent.  Thos. Ekins of Rushden Esq. John Atkins of Stanwick Esq.  Allex Ekins of Barton Clerk in ye County of Northampton John Sawyer Gent and James Sawyer Gent sons of my said brother John and to their heirs feoffees in Trust to and for ye uses intents and purposes after mentioned: i.e. to and for the use behoof and benefit of four poor widows or impotent persons forever two of ym to be of ye Parish or hamlets of Chelston cum Caldicot aforesaid or if other two of the Parish of Raunds aforesaid, but in case of Parishioners of Raunds shall not give good security to ye Parishioners of Chelston cum Caldicot to save them harmless from all manner charges which shall happen to ym by reason of their two persons comeing to inhabite therein then all of  ye said four persons to be of ye Parish of Chelston cum Caldicot aforesaid and in case any of the mortgage money due upon any of ye said mortgaged premises shall be paid in I doe hereby authorise ordaine and appoint my said feofees to purchase other lands therewith and to settle ye same to and for ye uses aforesaid and to elect constitute and appointe on of the said four poor persons to be Guardian for the other three and to see that  ye houses be kept in good repaire and to collect and receive the rents issues and profits thereof and to distribute the same equally to and amongst [ye] said four poor persons only he reserving to himself for his pains therein five shillings a year more than the other three and to have the best of the said houses for his habitation.  Allso my mind and will is that when any four or five of these feoffees shall be dead the other one or two of the said foeffees surviving or the heirs of the survivor shall elect make ordain and constitute so many more feoffees in their places and steads as shall make up the whole number of six againe.  And I doe hereby authorise and give them power to doe the same Allso my mind and will is that these words viz: This house was erected by James Sawyer Gent and Thomas Sawyer his son and ten pounds per Ann: by them given therewith for the use of four poor widows forever towards their maintainance date:… die:…  Ann: Dom:… to be deeply cut imprinted or ingraven in brass or on a stone and placed in ye side wall of the said house on ye forefront thereof with a stone over ym to preserve ym from the weather:  This was copied ye 15 Febr 1706/7 but as yet neither Raunds nor Chelston is ye better for it tho’ James Sawyer died seven year agoe next May.
